That limit decides most of these disputes. Florida is an employment-at-will state. Gessner v. Southern Co. explains that when employment is indefinite, either side may end it at any time for any reason. The at-will rule has an edge, though. An employee can’t be let go for a reason the law forbids, such as retaliation or unlawful discrimination (Laguerre v. Palm Beach Newspapers, Inc.).

So the real question isn’t whether a post was rude or offensive. It’s whether the reason for discipline is one the law allows. A post that threatens a coworker can support action. Three things shape the answer: what the post says, who wrote it and where it appeared, and how the employer responded.

Posts That Commonly Support Discipline

Posts that threaten or harass people, leak confidential business information, or break a clear written rule commonly give an employer a lawful reason to act. These categories give the strongest footing for discipline, though each still needs a fact check.

Threats or harassment. Posts aimed at coworkers, supervisors, customers, or vendors can justify discipline, especially when they target a specific person.

Confidential business information. Florida protects trade secrets. Under Florida trade secret law, a trade secret is information, such as a formula, method, or process, that derives independent economic value, actual or potential, from not being generally known and not being readily ascertainable by proper means, and that is the subject of reasonable efforts to keep it secret. Some pricing data and internal methods may qualify if they derive independent economic value from not being generally known and not being readily ascertainable by proper means by other persons who can obtain economic value from its disclosure or use, and the business makes reasonable efforts to keep them secret.

False and damaging statements. Untrue statements that harm the company or its people can support action, especially when the employer can point to concrete harm.

Violations of a clear, lawful policy. A rule the employee received and acknowledged gives the employer a firmer basis for discipline.

Even these categories have limits. A post that also complains about unlawful conduct needs its own review, as covered below.

Protected Concerted Activity Under Federal Labor Law

That protection is separate from Florida’s statutes, and it turns on what the post was meant to do. Discipline for a post that invites coworkers to act together on a workplace concern can create legal risk, even when the wording is heated. A solo complaint about a boss may stand on different footing. The key question is whether the employee acted on behalf of others or was only venting. Review the post’s audience, the replies, and whether coworkers joined in. Those details often separate protected group activity from an individual gripe. Because this area can overlap with the Florida rules in this article, review a post under both.

Posts About Discrimination, Harassment, or Illegal Conduct

A post that objects to illegal conduct can be protected, but only if the conduct really breaks a law. Florida’s private whistleblower statute covers employers with ten or more employees (Fla. Stat. § 448.101). It bars retaliatory personnel action against an employee who objects to or refuses to take part in a practice that violates a law, rule, or regulation (Fla. Stat. § 448.102). Under Fla. Stat. § 448.102(1), which covers an employee who disclosed, or threatened to disclose, to any appropriate governmental agency, under oath, in writing, an activity, policy, or practice of the employer that violates a law, rule, or regulation, the statute provides: “However, this subsection does not apply unless the employee has, in writing, brought the activity, policy, or practice to the attention of a supervisor or the employer and has afforded the employer a reasonable opportunity to correct the activity, policy, or practice.”

The Florida Supreme Court held in 2026 that the employee must show the practice really violates the law. Gessner explains that, to prevail in a retaliation claim alleging a violation of section 448.102(3), an employee must establish that the employer’s activity, policy, or practice to which the employee objected is, by definition, in violation of law. Section 448.103 itself allows a civil action for retaliatory personnel action taken in violation of the act, within 2 years after discovering the action or within 4 years after it was taken, whichever is earlier, and bars recovery if the employee failed to give the notice required by section 448.102(1) or if the action was predicated upon a ground other than the employee’s exercise of a right protected by this act. A complaint to the employer also matters. A disclosure claim requires written notice to a supervisor or the employer, and the employer must get a reasonable chance to fix the problem (§ 448.102).

Timing matters on both sides. A civil action generally must be brought within 2 years after discovering the action or 4 years after it was taken, whichever is earlier (§ 448.103).

Separately, the Florida Civil Rights Act bars discharge because of race, sex, religion, age, and other listed traits (§ 760.10). It reaches employers with 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year (§ 760.02). A complaint can be filed within 365 days of the alleged violation (§ 760.11). A post that describes discrimination at work may connect to these rules, so the timing and the employer’s size both matter.

Off-Duty Posts, Personal Accounts, and Links to the Employer

A post made on a personal account after hours doesn’t automatically shield it from discipline. It also doesn’t automatically justify discipline. Several facts shape the risk:

Whether the post names the employer, a supervisor, or a client.

Whether it was written on a personal device, outside work hours, for a personal audience.

Whether it touches workplace matters such as safety, pay, or conduct on the job.

Reposts, likes, and shares can be treated differently from original content. Look at what the employee actually wrote, not just a screenshot of it. Confirm who controls the account and what was posted before acting. The more clearly a post ties to the workplace, the more closely the employer’s stated reason will be examined.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Written Policies and Consistent Enforcement Affect Discipline

A clear, lawful written policy gives discipline a firmer footing, but a handbook is only part of the picture. Florida law generally holds that policy statements in a handbook don’t create enforceable contract rights unless the manual clearly says it is a separate employment contract (Quaker Oats Co. v. Jewell). So a policy works best when its wording is specific and the employee received and acknowledged it.

Rules that bar staff from discussing pay or criticizing management can create legal exposure of their own. Consistency matters too. If similar posts drew different responses from different employees, that gap can invite claims of discrimination or retaliation. Keep records of prior discipline for comparable conduct, and apply the policy the same way each time.

Public Employers Face Different Rules

Public employers follow different rules, and Florida’s Whistle-blower’s Act covers state agency employees. Protected disclosures go to bodies that can investigate or fix the problem. That is a separate body of law. A government employer shouldn’t apply the private-sector analysis without a separate review.

Common Mistakes Employers Make Before Disciplining Over a Post

The most common mistake is acting on a screenshot before checking where it came from. Several other errors come up often. Employers act on a screenshot without confirming it’s authentic, what came before it, or who posted or shared it. Employers also discipline a post that is actually a complaint about unlawful conduct or group talk about workplace conditions. And many employers don’t document the policy the post broke, the business impact, or how similar conduct was handled before.

Each gap weakens the employer’s position if the discipline is challenged. Decisions made in anger tend to skip these steps. Writing down the facts before any meeting gives a cleaner record.

Talk Through the Post Before You Act

A short legal review, before any discipline, can test the facts against these rules.
