A state minimum wage can sit beside a federal overtime rule. Coverage often depends on headcount, industry, or how a statute defines an employer. Check that definition before you rely on any threshold.

This page is general information, not legal advice. Under the Florida minimum wage amendment, the rate rises by $1.00 each September 30 until it gets there.

After that, the amendment adjusts the rate each year for inflation, using the CPI-W index. Each new rate takes effect on the following January 1. The Florida Minimum Wage Act carries the same annual adjustment process into state statute.

Tipped workers follow separate rules. An employer may credit tips toward the minimum wage only up to the allowable federal tip credit amount in 2003, as the amendment states. The amendment also says federal Fair Labor Standards Act case law should guide how it is read.

The financial stakes are real. A worker who wins a minimum wage claim can recover unpaid wages, the same amount again as liquidated damages (an extra penalty), and attorney’s fees. A court has discretion to reduce that extra penalty if the employer proves good faith and reasonable grounds. The amendment also bars retaliation against a worker who complains about pay.

Working Hours and Overtime Rules Employers Must Track

For most adult workers, the overtime rule comes from federal law: time and a half for hours over 40 in a workweek. The federal overtime rule requires pay at one and one-half times the regular rate for hours worked over that limit. Florida’s minimum wage rules sit alongside it, so an employer may need to meet both.

Many employers slip on exemptions. Executive, administrative, and professional workers can be exempt from overtime. The exemption turns on what the worker actually does and how the worker is paid. A job title alone does not settle it. Treating a worker as exempt when the duties don’t fit can lead to back-pay claims.

Records help you prove what you paid. Time cards, schedules, and pay stubs are often the first evidence reviewed in a wage dispute. Keep them complete and accurate for every worker, whether paid by the hour or by salary. Minors face their own hour limits, covered in the next section.

Child Labor Laws for Minors Under 18

Florida limits when and how long minors can work, and the limits depend on age and whether school is in session. The Florida child labor hours law sets the rules.

For workers 15 and younger, the law bars work before 7 a.m. or after 7 p.m. when school is scheduled the next day. It also bars more than 15 hours in a week when school is in session.

For 16- and 17-year-olds, the limits are later and longer. Minors in that group cannot work before 6:30 a.m. or after 11 p.m. when school is scheduled the next day. They also cannot work more than 30 hours in a week when school is in session. A parent, custodian, or school designee can waive the weekly limit on the required form. Some older minors fall outside these limits, including 16- and 17-year-olds who have graduated from high school or earned a high school equivalency diploma.

The law also treats a minor’s presence at work during working hours as evidence that the minor is employed. Keep age records and any waiver forms on file. Check current limits against the statute, because waivers and school schedules change the answer.

Core Federal Employment Laws That Apply in Florida

Federal law adds core duties on discrimination, disability accommodation, and family leave. Federal employment laws also apply to Florida employers, in addition to state law, though many of them depend on how many employees the employer has. Whether a given law reaches your business can turn on headcount and other tests.

Federal rules on unlawful employment practices bar many kinds of bias at work. The Americans with Disabilities Act rules bar discrimination against a qualified person with a disability in hiring, pay, promotion, and firing. They also require reasonable accommodations, unless the accommodation would impose an undue hardship on the business.

Under Section 623 of federal age discrimination law, it is unlawful for an employer to fail or refuse to hire or to discharge any individual, or otherwise discriminate against any individual with respect to compensation, terms, conditions, or privileges of employment, because of that individual’s age. It also includes exceptions the statute spells out, so read those closely. The federal family leave law gives an eligible employee up to 12 workweeks of leave in a 12-month period for listed reasons, and that leave may be unpaid.

Safety is a separate duty. The EEOC’s employee rights guidance for small employers covers discrimination and retaliation topics as well.

Florida-Specific Laws: Discrimination, Whistleblowing, E-Verify, and Restrictive Covenants

Florida adds its own rules on discrimination, retaliation, and worker verification. These apply alongside federal law, not in place of it.

The Florida employment discrimination statute makes it unlawful for an employer to discriminate because of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status. It also bars retaliation against someone who opposes a discriminatory practice or files a charge.

The Florida whistleblower protection statute bars retaliatory action against an employee who objects to a violation of law or gives information to an investigation. Some protections apply only after the employee raises the issue in writing with a supervisor or the employer. That gives the employer a reasonable chance to fix the problem. A written complaint from a worker can therefore trigger this law, so handle it with care.

The Florida E-Verify statute governs how employers verify that new workers can legally work. If the federal E-Verify system cannot be used for 3 business days after a new hire starts, the employer must use Form I-9. An employer also may not keep employing a worker after learning that the worker is an unauthorized alien. Public contractors face a separate E-Verify duty under the same section.

Non-compete and other restrictive agreements are a separate topic that this page does not cover.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Unfair Labor Practices and Employee Organizing Rights

An unfair labor practice is employer conduct that federal labor law prohibits, such as interfering with workers’ organizing. Section 8 of the National Labor Relations Act lists those practices.

Examples in the statute include dominating or interfering with a labor organization. Another example is discriminating in hiring or job tenure to encourage or discourage union membership. Employer actions that look minor can fall into these categories, so review them against the statute’s text.

These rules turn on specific facts.
