Wilson · Published October 28, 2026

Calling a worker an independent contractor does not settle the question in Florida. The law looks at the actual working relationship, not only the contract or the tax form. This page explains how that test works, which warning signs matter most, and how an independent contractor misclassification Florida employer attorney can help a business that is unsure. KEW Legal is a Florida business law firm with offices in Coral Gables and Sunny Isles Beach. It serves business owners and investors across Miami-Dade and Broward County.

What Independent Contractor Misclassification Means for a Florida Employer

Misclassification happens when a business treats a worker as an independent contractor, but the law treats that worker as an employee. The label on the paperwork is not the final word.

That wording reaches past signed documents. A verbal deal can create an employment relationship.

A 1099 form reports payments. It does not decide who the worker is. Owners often assume the form and the signed agreement protect them. Those documents help only when the daily work matches them.

This issue usually comes up in three settings:

A business uses the same contractors every week for its core work.

A company bought or inherited a business and kept its contractor setup.

An owner has paid a worker as a contractor for years without a second look.

This page covers the employer side: how to test the arrangement and how to defend the business position if a worker or agency raises the issue.

If a contractor's daily work looks like a job, or a wage demand or agency letter just arrived, send us the agreements so we can review the facts with you. Those rules center on who controls the work.

The reemployment tax statute covers service performed by an individual who, under the usual common-law rules, is an employee (Fla. Stat. § 443.1216). In practice, reviewers commonly ask:

Who decides how, when and where the work gets done?

Does the worker supply his or her own tools, equipment and workspace?

Can the worker make a profit or take a loss on the job?

Is the work part of the company’s core business?

Is the relationship ongoing, or tied to one project?

Does the business train the worker or require company procedures?

Florida’s minimum wage rules take a related route. The Florida minimum wage amendment gives “Employer,” “Employee” and “Wage” the meanings used under the federal Fair Labor Standards Act. It also says federal case law and agency interpretations guide its meaning.

These tests overlap but are not identical. A sound review looks at each one that applies to the business’s facts.

Warning Signs Your Contractor Arrangement May Be Exposed

The biggest warning signs are control, fixed hours and work at the center of the business. One sign rarely decides the question alone. Several signs together raise the risk.

Check for these patterns:

Set schedule. The business sets the hours or days the worker must be available.

Core work. The worker does the main service you sell, such as deliveries for a delivery company or styling at a salon.

Company tools and identity. The worker uses company email, badges, uniforms or software, or reports to a supervisor.

Exclusive work. The worker serves one company for a long stretch and turns down other clients.

Salary-style pay. The worker is paid by the hour or on a fixed regular schedule, not per project.

Company training. The worker learns company procedures or must follow company policies.

If several of these describe your arrangement, a review is worth doing now. It’s better to look before a claim or an agency letter arrives.

What Misclassification Can Expose an Employer To

A misclassified worker who prevails may recover the full unpaid minimum wages plus the same amount as liquidated damages (extra damages equal to the unpaid wages), and reasonable attorney’s fees and costs, unless the employer proves by a preponderance of the evidence that the act or omission was in good faith and that it had reasonable grounds for believing it was not a violation. In that case, the court may award no liquidated damages or an amount up to the unpaid wages. Those amounts can grow across several workers and several years.

Under Florida’s minimum wage amendment, a worker who wins recovers the full unpaid back wages plus the same amount as liquidated damages, along with reasonable attorney’s fees and costs (Florida minimum wage amendment). Stat. § 448.110(8), the limitations period is the period of time specified in s. 95.11. A court may award no liquidated damages, or an amount up to the unpaid wages, if the employer proves by a preponderance of the evidence that its act or omission was in good faith and that it had reasonable grounds for believing it was not a violation (Fla. Stat. § 448.110).

A worker must first give the employer written notice before suing for unpaid minimum wages. The notice must state the wage claimed, the work dates and hours, and the total unpaid amount. Fees can also be awarded: a court may award costs and a reasonable attorney’s fee to the prevailing party in an unpaid wage action (Fla. Stat. § 448.08).

If an employer fails to secure workers’ compensation, the state must assess a penalty of up to $5,000 for each worker wrongly classified as a contractor (Fla. Stat. § 440.10 requires every employer coming within the chapter to secure workers’ compensation payments for its employees. Firing or punishing a worker for raising the issue creates a separate problem. Florida employers who face these issues often need an independent contractor misclassification Florida employer attorney early.

What the Engagement Covers

KEW Legal reviews the contractor relationship, plans any change and handles agency or worker claims for the business.
