It asks your business to pay money, change something, or answer by a set date. Treat it as a serious document, and have counsel review it before anything goes out.

This page explains what the letter means, which deadlines may apply, and how a Florida employer attorney handles the response. KEW Legal is a Florida business law firm with offices in Coral Gables and Sunny Isles Beach. The firm serves business owners and investors across Miami-Dade and South Florida.

What a Former Employee’s Demand Letter Is and Who It Is For

A demand letter is a written claim sent by a former employee or the employee’s lawyer. It states what the person wants. That might be back pay, severance, reinstatement, or a payment to settle the matter.

A demand letter is a starting point, not a court filing. Still, the way your business answers it can shape what happens next.

This page is written for owners, executives, and HR managers in Miami-Dade, Broward, and nearby areas. Some received the letter directly. Others handle it for the company.

Outside general counsel works as a business’s standing legal advisor. For a demand letter, counsel reviews the claim, advises on the response, and handles communication with the former employee or their lawyer.

If a demand letter from a former employee has reached your business, you don't have to work out the response alone; our team can review it with you. The employer then has 15 calendar days after receiving that notice to pay or resolve the claim. The filing period is paused during those 15 days.

Retaliation. Under Fla. If neither issues within 180 days after the complaint, the suit may be filed within 18 months after the complaint.

For purposes of the Florida Civil Rights Act, an employer is any person employing 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year, and any agent of such a person, as Fla. Stat. § 760.02 defines that term. The EEOC employer guidance covers federal duties that apply to employers.

Write down the date the letter arrived and any response date it states. Those are often the first facts counsel needs. Deadlines can be running even when the letter names none.

Do Not Ignore It, and Do Not Respond Alone

Silence and a rushed reply both carry risk. Silence leaves your business without a documented position. A quick reply can include statements that later read as admissions.

Counsel review helps in three ways. It checks the claim against your records. It identifies which deadlines may apply. It keeps your written words consistent with your position.

Counsel can also route all contact through one channel. The former employee’s side then hears from one voice. Managers avoid answering questions they should not answer alone.

Counsel review should happen before any reply goes out, including a short note saying the matter is under review.

Preserve Records Immediately

Start by saving everything that relates to the employee. Relevant records usually include:

Personnel file, offer letter, and job description

Pay, timekeeping, and overtime records

Performance reviews, written warnings, and termination paperwork

Emails, texts, and messaging-app records, including personal phones used for work

A litigation hold is an internal instruction to stop routine deletion and keep relevant records intact. It should reach managers and any personal devices used for work.

Do not edit, backdate, or annotate existing records. Do not discuss the claim with coworkers unless counsel guides the conversation. Some employment practices insurance policies have notice requirements, so counsel can check whether a policy applies.

How Employer Counsel Works Through the Response

Employer counsel works in four steps. The timeline varies with the claim and the response requested.

Intake and review. Counsel reads the letter, the employee file, and the timeline. Counsel then summarizes the claims and any deadlines in writing.

Evaluation. Counsel checks each claim against the documents and the law. Counsel lists what the business still needs to provide.

Decision. With the business, counsel chooses a path: respond, request more detail, negotiate, or prepare for the next step.

Communication. Counsel handles contact with the former employee or their lawyer, tracks all correspondence, and updates the business at each stage.

Florida is an at-will employment state. Either side may end the job at any time for any reason. An employer still cannot fire someone for a reason the law prohibits, such as retaliation or unlawful discrimination.

Should You Try to Resolve It Directly?

Talking directly with the former employee can feel faster. But anything said can later become evidence. A casual remark about performance, or a promise made on the phone, may be quoted back later.

An early conversation can make sense when the facts are clear and the goal is a narrow fix. A prepared written response is often the better first step when the claims are broad, a deadline is running, or the records are incomplete.

Counsel also checks the documents that frame the dispute. Employee handbooks are a common example.

Counsel also reviews arbitration agreements, separation agreements, and worker classification. Each one can change how the response should be handled.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why Clients Work With KEW Legal on Employer Matters

KEW Legal is a Florida business law firm that works as outside general counsel for business owners and investors.
