This guide maps those risks from the business side, so owners and managers can see what the rules ask of them and when to bring in counsel.

KEW Legal focuses its practice on business law, with offices in Coral Gables and Sunny Isles Beach. The firm advises business owners and managers across Miami-Dade and South Florida as outside general counsel. Kristina E. Wilson is the responsible lawyer for this page. The firm’s lawyers include Kristina E. Wilson and Natalie Martinez.

The risk map below covers discrimination and retaliation charges, wage and final pay claims, worker classification, restrictive covenants, terminations and references, handbooks and drug testing, and layoffs. Each section names the rule that applies. Florida has its own employment statutes, and federal laws add another layer.

The Florida Civil Rights Act bars discrimination based on race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status. Fla. Stat. § 760.10 sets out those unlawful practices. Federal laws such as Title VII of the Civil Rights Act and the Fair Labor Standards Act also reach many Florida workplaces. Florida’s minimum wage rules come from the state constitution and from Fla. Stat. § 448.110.

Coverage depends on the facts. Thresholds such as the number of employees differ from one statute to another. The same workplace can fall under one rule but not another.

Most employers learn their obligations after an agency notice arrives. A better habit is to review pay practices, policies and agreements before a problem starts. That kind of ongoing review is a core part of outside general counsel work.

Discrimination, Harassment and Retaliation Charges

A discrimination or retaliation charge says an employer treated a worker unfairly because of a protected trait or because the worker spoke up. Both claims carry real exposure, so the response matters.

Florida law also bars retaliation. Fla. Stat. § 760.10 states this rule. Under § 760.10(11), each employer must post and keep posted in conspicuous places upon its premises a notice provided by the Florida Commission on Human Relations.

If a case goes to court, the remedies can be significant. A court may order back pay and award compensatory damages, including damages for mental anguish, under Fla. Stat. § 760.11, which sets these remedies; § 760.10 itself defines unlawful employment practices and does not set remedies. Punitive damages are capped at $100,000 for an aggrieved person. Fla. Stat. § 760.11 sets these terms.

Timing is strict. A civil action must start within 1 year after a reasonable cause determination or an EEOC Notice of Right to Sue, whichever is earlier. If no determination issues within 180 days, the deadline is 18 months after filing. Agency deadlines are short, so respond quickly. Preserve documents and send agency letters to counsel. Related guides cover EEOC charge responses and discrimination defense in more detail.

Wage, Hour and Final Pay Claims

Wage claims usually start with unpaid time, a misclassified worker, or pay below the legal minimum. Each one can turn into a costly case if it goes unanswered.

Article X, Section 24 of the Florida Constitution and Fla. Stat. § 448.110 provide for adjustments to the state minimum wage, a process that began with the initial adjusted rate effective January 1, 2006. Fla. Stat. § 448.110 implements that provision and directs the Department of Commerce to calculate and publish each adjusted rate. A worker who wins recovers the unpaid wages plus the same amount as liquidated damages, along with reasonable attorney’s fees and costs. The court can reduce liquidated damages if the employer shows good faith and reasonable grounds.

See Fla. Const. art. X, § 24.

Florida also has a daily labor rule. Ten hours of labor is a legal day’s work, unless a signed written contract sets a different number of hours. Without that contract, a worker employed to perform manual labor is owed extra pay for all work performed by the requirement of the employer in excess of 10 hours in a day. Fla. Stat. § 448.01 sets this rule.

In a wage suit, Fla. Stat. § 448.08 lets a court award the prevailing party costs and a reasonable attorney’s fee. Keep clear time records and pay records. Those records often decide the question.

Worker Classification and Restrictive Covenants

Worker classification and restrictive covenants are two areas where business owners often rely on paperwork. The label on a contract is only one part of the picture. The day-to-day facts of the work matter too.

Under § 542.335, a restraint that lacks a legitimate business interest is unenforceable.

Section 542.335 also requires a court to modify an overbroad restraint and grant only the relief reasonably necessary to protect the legitimate business interest. An employer that drafts a broad clause may end up with a narrower one.

Certain covered noncompete agreements follow separate rules. The employer must give the proposed agreement at least 7 days before an offer expires. Fla. Stat. § 542.45 sets these requirements. In an enforcement action, the prevailing party can recover reasonable attorney fees and costs.

Review existing agreements with current staff before relying on them. Update templates for new hires. Keep proof of when and how each document was delivered.

Terminations, Wrongful Termination Claims and Employment References

In Florida, an at-will employee can be fired at any time, but not for a reason the law prohibits. Issues such as retaliation and discrimination are examples of employment matters that employers may need to address.

The Laguerre v. Palm Beach Newspapers decision states this rule. Florida law also lets an employer generally end at-will employment without stating a reason. USAGov explains that rule, along with its limits.

Florida does not recognize a general common-law claim for retaliatory discharge. In Gessner v. Southern Co. (2026), the Florida Supreme Court said that tort has never been recognized in the state. A fired worker must rely on a contract or statute. Whistle-blower claims are one example.

A worker generally has 2 years after discovering the action or 4 years after it was taken, whichever is earlier, to sue. Fla. Stat. § 448.103 sets that deadline.

The Gessner decision also matters for employers.

References follow a separate rule. Under § 768.095, the employer’s protection does not apply if it is shown by clear and convincing evidence that the information was knowingly false or violated a civil right under chapter 760. Florida courts usually do not treat handbook statements as a binding contract on their own.

Under Quaker Oats Co. v. Jewell, policy statements in a manual do not create enforceable contract rights. The exception is specific language showing the parties agreed the manual is a separate employment contract. Employers should know which language they use.

Outdated or inconsistent policies create the most trouble. Review the areas that generate complaints. Anti-harassment and complaint procedures come first. Leave, timekeeping, social media use and at-will language also need a check. A policy that says one thing while managers do another invites a dispute.

Drug testing policies need the same care. Write the rules clearly, apply them the same way to each worker, and keep records. A separate guide on drug testing policy for Florida private employers covers this topic in more detail.

Layoffs, Reductions in Force and WARN Notice Planning

A layoff plan should be built on documented criteria, not on memory or instinct. Uneven selection is one of the easiest ways to invite a claim.

Plant closings and mass layoffs can raise questions about notice obligations. Those rules have their own triggers and content requirements, so check them before the first notice goes out. Timing also matters. Final pay, benefit continuation and any pending charge all need to line up with the plan.

Retaliation is a real risk in layoffs. Florida law bars discrimination against a person for opposing an unlawful practice or for taking part in a complaint. Fla. Stat. § 760.10 states this rule. A layoff that follows a complaint can draw scrutiny, even if the business had a sound reason.

Document the business reason and the selection method in writing. Review the list of affected workers for patterns before notices go out. A short review with counsel at this stage often costs less than a dispute later.

When to Call Employment Counsel and How Outside General Counsel Works

Call counsel when an agency notice, demand letter, lawsuit or planned termination arrives. Ideally, call before the decision is final. Early review often leaves more room to choose a path.

Outside general counsel works differently from a single matter. The lawyer reviews policies, agreements and pay practices on an ongoing basis. The lawyer also answers the daily employee questions that come up between disputes. This steady contact helps catch small gaps before they become claims.

A matter may be referred to another lawyer or firm where that applies. KEW Legal will tell you if that happens in your case.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can a Florida employer fire an at-will employee without a reason?

Generally yes, but not for a reason the law prohibits, such as retaliation or unlawful discrimination.
