Wilson · Published October 27, 2026

An employee handbook review is a legal read of your workplace policies. It checks each rule for legal risk, conflicts with other documents, and fit with how your business actually runs. For Florida employers, that means testing the handbook against federal rules and Florida law, not just a generic template. This page explains what a review covers, the gaps it often finds, and how the work is done. KEW Legal serves business owners and investors across Miami-Dade, Broward County, and South Florida from offices in Coral Gables and Sunny Isles Beach.

What an Employment Policy and Handbook Review Is, and Who It Is For

A handbook review is a line-by-line legal check of your handbook and standalone policies. It finds language that creates exposure, clashes with other documents, or no longer matches your operations.

You likely need one if:

Your handbook has not been reviewed in several years.

Your company has grown, added locations, or added pay types such as commissions or bonuses.

You bought or inherited a business that already has policies in place.

You received an employee complaint or an agency inquiry.

A template handbook is written for a generic company. A reviewed handbook is written for your workforce, your locations, and your pay practices. The review also checks whether managers apply the written rules the same way.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What the Review Covers: Core Provisions Florida Employers Should Check

The review focuses on the provisions that carry the most legal risk. Each one should match both the law and daily practice.

At-will language. Under USAGov’s termination guidance for employers, an employer may generally end at-will employment without stating a reason. That right has limits. An employee cannot be fired for a reason the law prohibits, such as retaliation or unlawful discrimination, as Laguerre v. Palm Beach Newspapers explains.

Contract language. Florida courts have held that handbook policy statements generally do not create enforceable contract rights. The exception is specific language showing the handbook is a separate employment contract, as Quaker Oats Co. v. Jewell holds.

Fla. Stat. § 448.102 also prohibits an employer from taking retaliatory personnel action against an employee because the employee has objected to, or refused to participate in, an activity, policy, or practice of the employer that violates a law, rule, or regulation. For an employee who disclosed, or threatened to disclose, an employer’s violation of a law, rule, or regulation to an appropriate governmental agency, under oath, in writing (subsection (1)), Fla. Stat. § 448.102 reads: “However, this subsection does not apply unless the employee has, in writing, brought the activity, policy, or practice to the attention of a supervisor or the employer and has afforded the employer a reasonable opportunity to correct the activity, policy, or practice.”

Pay. Florida’s minimum wage is set by the state constitution. It rises each September 30 until it reaches $15.00 per hour on September 30, 2026, so pay language should reflect the current rate under the constitutional minimum wage text.

Common Gaps Found in Florida Employee Handbooks

Policies that promise more than a business does, and rules copied from a template, can leave gaps.

Old job titles, benefit plans, or legal references the business no longer uses.

Promised steps, such as a grievance timeline or progressive discipline, that managers skip.

Conflicts with offer letters, independent contractor agreements, or benefit plan documents.

A single complaint route, or vague anti-retaliation language.

Different rules by office or department, with no clear reason.

No language on remote work, commissions, or bonuses.

No signed acknowledgment on file, so the business cannot show what staff received.

A disclaimer alone does not fix these gaps. Your written policies and daily practice need to match. A written complaint route also matters. Florida’s private whistle-blower provision protects employees who object to a practice that violates law.

How the Review Works: Steps and What to Expect

A review usually runs in five steps, from the first conversation through rollout of revised policies.

Initial conversation. You describe your business, headcount, locations, current handbook, and why you want the review now.

Document gathering. You provide the handbook, standalone policies, offer letter and contractor templates, and any recent complaint or agency letters.

Line-by-line legal review. Each provision is checked against federal and Florida requirements and against how your business operates.

Written findings. You receive a summary ranked by legal exposure, with the sections to change and the reason for each change.

Revised language and rollout. Updated text, manager guidance, and new acknowledgment forms are drafted and put into use.

Timing depends on the handbook’s length, the number of standalone policies, and how many people must approve changes. After rollout, keep signed acknowledgments and a record of the version in effect on each date.

Why Employers Work With KEW Legal on Handbook Review

KEW Legal handles handbook review as part of outside general counsel work for business owners in Miami-Dade, Broward County, and South Florida.

The firm has offices in Coral Gables and Sunny Isles Beach.

Outside general counsel work means a handbook review can sit alongside the contracts, commercial leases, partnership, and succession matters your business already handles.

The firm focuses on employment law for employers, including policy drafting and workplace rules.

Kristina E. Wilson is the lawyer responsible for this page. Natalie Martinez is also one of the firm’s lawyers.
