This guide explains what that attorney does and which rules matter most. Business owners make hiring, pay, discipline, and firing decisions every week. Each one carries legal duties under Florida and federal law. Some deadlines are short. This is general information, not advice about your situation.

What Does an Employment Law Attorney Do for Employers?

An employment law attorney for employers advises the business on people decisions before a dispute starts. That work covers hiring terms, pay practices, leave questions, discipline, and termination. It also covers the written policies managers follow day to day. This is preventive counsel, and offer letters, handbooks, and policies are its main tools.

Defending a claim is a different job. That work starts when a worker files a charge, a complaint, or a lawsuit. The attorney reviews the records and deadlines, then explains the options in plain terms.

KEW Legal focuses on employers and business owners in Florida. The practice is supported by office staff. Kristina E. Wilson is the attorney responsible for this page.

Some owners use outside general counsel. In that setup, employment questions fall within the scope of the outside general counsel services described here. A one-time matter covers a single question, such as reviewing one termination letter.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Which Employment Issues Do Broward Employers Commonly Face?

Broward employers face employment issues in four general areas. Each one needs different records and a different response.

Terminations and reductions in force. A reduction in force cuts positions for business reasons. The file should show the reason, how people were chosen, and the dates. Timing matters. A firing that follows a complaint closely can look like retaliation, so document the reason before the decision.

Harassment complaints. Under federal rules, an employer can be responsible for coworker harassment. The federal sexual harassment regulation addresses situations where the employer (or its agents or supervisory employees) knows or should have known of the conduct, unless it can show that it took immediate and appropriate corrective action (EEOC sexual harassment regulation). Prompt, written steps are the practical answer.

Wage and hour questions. These cover overtime status, final paychecks, and recordkeeping. Under the Fair Labor Standards Act, an action to enforce a cause of action for unpaid minimum wages, unpaid overtime compensation, or liquidated damages may be commenced within two years after the cause of action accrued, except that a cause of action arising out of a willful violation may be commenced within three years after it accrued (federal limitations provision for FLSA claims). Rules change, so confirm current requirements.

Handbook gaps. A written handbook sets expectations for staff and managers. It should be reviewed as headcount and job roles change.

Do Florida and Federal Laws Bar Retaliation Against Employees?

Under Title VII and the Florida Civil Rights Act, which generally cover employers with 15 or more employees, retaliation against workers who complain about discrimination or take part in a proceeding is generally prohibited, provided the activity meets the statutory standard.

Under the Florida Civil Rights Act of 1992, an employer may not discriminate against a person because that person opposed a practice made an unlawful employment practice under this section. The same rule applies if the person filed a charge or took part in a hearing.

Florida’s minimum wage law also bars retaliation for exercising rights under Article X, section 24 of the Florida Constitution (Fla. Stat. § 448.110).

Federal law has a parallel rule. Under Title VII, it is an unlawful employment practice for an employer to discriminate against any of its employees or applicants for employment because the person has opposed any practice made an unlawful employment practice by that subchapter, or because the person has made a charge, testified, assisted, or participated in any manner in an investigation, proceeding, or hearing under it (Title VII anti-retaliation provision).

Workers face deadlines too.

Employers reduce risk by documenting business reasons, applying discipline the same way, and training managers how to receive complaints. Whether a specific action counts as retaliation depends on the facts. A general article can’t answer that for your business.

Can an Attorney Predict the Odds of Winning an Employment Lawsuit?

No attorney can reliably predict the outcome of an employment claim. Results depend on the evidence, the agency or court involved, the witnesses, and the documents.

A lawyer can review the records, flag deadlines, outline defense or resolution options, and explain risks in plain terms. This page does not promise or forecast results for any employer.

Preservation matters early. Once a complaint or agency notice is expected, pause routine deletion of emails, texts, and schedules. Each employer shall preserve its payroll records for at least 3 years from the last date of entry (federal wage-and-hour recordkeeping regulation). Those records often show what actually happened.

How Are Employment Legal Fees Discussed?

The first consultation is free, confidential, and without obligation to continue.

That meeting gives you room to share the facts, documents, and key dates. Bring the termination letter, the complaint, any agency notice, and the relevant handbook section. You can also ask how the attorney would approach your question.

Before you agree to anything, ask for fee terms in writing.

Where Does KEW Legal Serve Broward County Employers?

KEW Legal’s bona fide offices are in Coral Gables and Sunny Isles Beach, Florida.
