Wilson · Published October 13, 2026

If you are looking for an employment lawyer for business owners Florida, the work usually falls into four areas. Those are employee disputes, departures, restrictive covenants such as non-competes, and worker classification. KEW Legal is a Florida business law firm with offices in Coral Gables and Sunny Isles Beach. Its employment work for employers is limited to these four issue areas. This page explains the rules that often apply, what to gather before you call, and how these issues connect to the rest of your business. It is general information, not legal advice for your situation.

What Employment Counsel Covers for Florida Employers

Employment counsel for employers is advice and representation on how a business manages its workforce. At KEW Legal, that work is limited to employee disputes, departures, restrictive covenants and worker classification. Kristina E. Wilson is the lawyer responsible for this page, and the practice has support staff who handle office work. The offices are in Coral Gables and Sunny Isles Beach.

Employment questions rarely stand alone. An owner dealing with a worker often also has a vendor contract to enforce, a commercial lease to manage, or a partner who disagrees about the business. KEW Legal acts as outside general counsel for business owners and investors across Miami-Dade and South Florida. That model covers ongoing business questions. A key employee’s non-compete, for example, can matter when an owner plans to sell. That overlap is why these questions are often reviewed together.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Employee Disputes and Internal Complaints

Employee disputes usually begin with a complaint inside the business. Common triggers include performance reviews, wage disagreements, harassment or discrimination complaints, and clashes between managers.

Federal law makes it unlawful for an employer to limit or classify employees in a way that takes away job opportunities because of race, color, religion, sex, or national origin. Florida law covers more traits. Under Fla. Stat. § 760.10, an employer may not discriminate about pay or conditions of work because of age, handicap, marital status, pregnancy and other listed traits.

Retaliation is a separate risk. Federal law bars an employer from discriminating against a worker who opposes an unlawful practice or takes part in a charge or proceeding. Acting against a worker because of a complaint can create a second problem. Review the timing before any discipline.

Your written response matters. Dated notes, the policy you applied, and a clear written reply show what happened and when. Nothing about these steps predicts how a particular complaint will turn out. Local county rules can also add duties beyond state and federal law.

Terminations, Resignations and Departures

A termination goes better when the reason is documented and the process is consistent. Before you meet with the worker, gather the written policies, prior warnings, pay records and any signed agreements. Those records show what the business relied on and when.

Florida also protects workers who speak up about legal violations. Under Fla. Stat. § 448.102, an employer may not take retaliatory personnel action against an employee who objects to or refuses to join a practice that violates a law, rule or regulation. The same rule covers an employee who gives information to an investigating agency. A worker who reports to a government agency must meet one extra requirement. The worker must first raise the problem in writing with a supervisor or the employer and give the employer a reasonable opportunity to correct it.

Records also matter after the worker leaves. Federal rules require employers to keep payroll records for at least 3 years from the last date of entry. Section 516.5 requires each employer to keep, for at least 3 years from the last date of entry, all payroll or other records containing the employee information and data required under the applicable sections of that part.

Resignations, cut hours and layoffs raise their own questions about pay and records. Each one depends on the facts and the agreements in place. Review them before the change takes effect.

Restrictive Covenants: Non-Competes, Non-Solicitation and Confidentiality

A Florida restrictive covenant is enforced only if the statute’s conditions are met. A non-compete limits a former worker from competing. A non-solicitation agreement limits taking clients or co-workers. A confidentiality agreement protects business information.

Under Fla. Stat. § 542.335, a court shall not enforce a restrictive covenant unless it is in a writing signed by the person against whom enforcement is sought. The party seeking enforcement must prove a legitimate business interest, such as trade secrets. That party must also prove the restraint is reasonably necessary to protect that interest.

An overbroad or overlong restraint is not always thrown out. The statute says a court shall modify it and grant only the relief reasonably necessary. A covenant not supported by a legitimate business interest is void and unenforceable.

The statute also addresses remedies. A violation of an enforceable covenant creates a presumption of irreparable injury for the party seeking enforcement. No temporary injunction may be entered without a proper bond.

Whether a particular agreement holds up depends on its wording and the facts. Nothing here predicts how a court would rule on your agreement.

Worker Classification: Employee or Independent Contractor

A contract label alone does not decide whether a worker is an employee or an independent contractor. As the federal regulation on independent contractor status explains, the Act’s minimum wage, overtime pay, and recordkeeping obligations apply only to workers who are covered employees, and calling employees “independent contractors” does not make these protections inapplicable.

The test focuses on economic reality. The key question is whether the worker is economically dependent on the business for work, or is in business for themself. Economic dependence does not turn on how much income the worker earns or whether the worker has other income.

Florida’s reemployment assistance law starts from a similar place. Under Fla. Stat. § 443.1216, covered employment includes an individual who is an employee under the usual common-law rules of the employer-employee relationship. Classification also affects tax and insurance duties.

Misclassification often surfaces when a worker files a claim or a payroll audit begins. The goal is a contract that matches the actual work. A contract that does not match the work creates risk.

Wage-and-Hour Compliance and Employee Handbooks

Wage-and-hour compliance means paying covered workers at the rates the law sets and keeping the records it requires. Section 206 requires every employer to pay each of his employees who in any workweek is engaged in commerce or in the production of goods for commerce, or is employed in an enterprise engaged in commerce or in the production of goods for commerce, wages at the rates listed in that section. The same section bars sex-based pay differences for equal work under similar conditions, subject to listed exceptions.

Florida’s minimum wage provision adds its own remedies. A worker who prevails recovers unpaid back wages plus the same amount as liquidated damages (an added sum equal to the back wages). The worker also recovers reasonable attorney’s fees and costs. Under Fla. Const. art. X, § 24, the limitations period is four years, or five years for willful violations.

That provision also bars retaliation for asserting minimum wage rights. Fla. Stat. § 448.110 repeats that bar.

A handbook review checks the policy language, any arbitration or waiver terms, and whether written rules match what the business actually does. Handbook review is part of the employment work for employers. It does not replace individualized advice on a specific worker or question.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Florida and Miami-Dade Considerations for Employers

Florida employers answer to both state and federal law. Some federal rules apply based on the business and the worker’s role. Florida statutes such as the restrictive covenant law and the minimum wage provision apply to Florida workplaces. Where state and federal rules overlap, both need review.

This page does not list those local rules. The rules for your city or county should be checked for your specific workplace.

KEW Legal’s offices are in Coral Gables and Sunny Isles Beach. Each one involves a written agreement, a set of records and a decision you need to make carefully.

Is a non-compete enforceable in Florida?

It can be, but only if it is in a signed writing, rests on a legitimate business interest, and is reasonably necessary. A court may modify an overbroad restraint instead of voiding it.

Does calling a worker an independent contractor settle the question?

No. Federal rules look at economic reality, not the label on the contract.

Does KEW Legal work as an employment lawyer for business owners Florida?

KEW Legal’s employment work for employers is limited to employee disputes, departures, restrictive covenants and worker classification.

If an employee has left for a competitor, or you’re unsure whether a worker belongs on payroll, call KEW Legal at 305-990-2300 or send a message through the contact page.
