Wilson · Published October 26, 2026

An employee handbook attorney in Miami-Dade reviews your written workplace policies against the laws that apply to your business, then shows you where they fall short. KEW Legal is a Florida business law firm with offices in Coral Gables and Sunny Isles Beach. Its employment work for employers is part of outside general counsel services for owners and investors across Miami-Dade and South Florida. Kristina E. Wilson is the responsible lawyer for this page. Below is what a handbook review covers, how it works, and why the handbook matters when an employment question comes up.

What an Employee Handbook Review Is and Who It Is For

A handbook review is a lawyer’s read of your written policies against Florida and federal employment law. It also compares those policies with how your business actually runs. If you don’t have a handbook yet, the same work can produce a new one.

The review fits owners and managers of businesses with employees in Miami-Dade, Broward, and South Florida. It fits companies using a template from years ago. It also fits companies that have never written their rules down.

The handbook matters most when something goes wrong. When an employee makes a claim, the handbook is often one of the first documents an agency, a court, or the other side asks for. A policy that reads well can still hurt you if managers don’t follow it.

Most reviews start with a specific question. Maybe you want to know whether a policy still applies. Maybe a manager asked how to handle a complaint, or a dispute exposed a gap. The review then checks the whole document, not just that one question.

If a handbook question is sitting on your desk after a manager's question or a complaint, you don't have to work through it alone. It also covers the paperwork that proves employees received them. Each part is checked against your headcount and locations, because some rules apply only above certain employee counts.

Equal treatment and harassment. Anti-harassment language, how complaints are reported, and who investigates them.

Retaliation protection. Language that makes clear employees can raise concerns without punishment.

Timekeeping and overtime. How hours are recorded, how breaks are handled, and how overtime is classified.

Leave. Sick leave, jury duty, and domestic or sexual violence leave where the law requires it.

Discipline and at-will language. How terminations are described, and whether the handbook makes promises a court could read as a contract.

Confidentiality and restrictions. Non-solicitation, confidential information, and rules on email, phones, and social media.

Remote work. Timekeeping for off-site staff and for employees who work outside Florida.

Acknowledgments and revisions. Signed receipt forms, the effective date, and the disclaimer that explains how the handbook is read.

How the Review Works, Step by Step

The review moves through five steps, from a first conversation to rollout of the final policies. Most of the work goes into comparing your written rules with how your managers apply them.

Free first consultation. The firm learns about your business, your headcount, your locations, and why you’re reaching out. The first consultation is free, confidential, and carries no obligation to continue.

Document intake. You send the current handbook, offer letter templates, past policy notices, and any questions managers have raised.

Legal analysis. Each policy is compared with current federal and Florida requirements and with actual practice.

Written findings. You get a plain-language list showing what must change, what should change, and which items are business choices.

Final language and rollout. You decide the final wording on a review call. Managers get guidance on explaining the policies before employees sign new acknowledgments.

How long each step takes depends on the handbook’s length and how many decision-makers must approve changes. A short handbook can move quickly. A longer one with several owners usually takes more time.

What the Employer Receives

You receive a written review memo. If drafting is included, you also receive a revised handbook and tools to roll out the new policies. Each item is written so an owner can act on it without a law degree.

A review memo that names each problem or missing policy and explains the reason in plain language.

A redlined or fully revised handbook, with changes marked for your approval.

Talking points for managers who will explain the new policies to staff.

Template acknowledgment forms and a suggested schedule for updating the handbook.

A short list of decisions the owners should settle before the handbook is issued.

Keeping the handbook current matters because both the law and your business change over time. A set schedule turns the update into a routine task instead of a crisis.

Policy Gaps That Often Matter in a Dispute

The gaps that cause the most trouble are usually places where the written rule and daily practice don’t match. These are the ones that tend to matter most when a claim is made.

Complaint routes that lead to the accused. A harassment policy that sends complaints only to the supervisor being accused leaves employees with no real option.

Retaliation risk. Florida law makes it unlawful to discriminate against a person for opposing a discriminatory practice or for taking part in a proceeding (Fla. Stat. § 760.10). Handbook language should never discourage complaints.

Objections to unlawful practices. An employer may not retaliate against an employee who objects to or refuses to join a practice that violates a law, rule, or regulation (Fla. Stat. § 448.102).

Promises of process. Handbook text that promises progressive discipline, which managers then skip, can invite a claim that the company broke its own rules. Under Quaker Oats Co. v. Jewell, a manual usually creates no contract rights unless it says so explicitly.

Missing signed acknowledgments. Without a signed form, it’s hard to show an employee received the policy.

Overbroad rules. Confidentiality and social media rules drafted too broadly may not be applied consistently.

What Is Legally Required and What Employers Cannot Write Into a Handbook

Discrimination. Florida prohibits discharge or other discrimination because of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status (Fla. Stat. § 760.10).

Jury service. An employer may not dismiss an employee because of the nature or length of jury service. A person who is dismissed may bring a civil action (Fla. Stat. § 40.271).

Domestic and sexual violence leave. These protections apply to employers with 50 or more employees and to employees with at least 3 months of service. An employer may not discharge, demote, suspend, or retaliate for using this leave (Fla. Stat. § 741.313).

At-will employment. Florida is an employment-at-will state.
