Wilson · Published October 26, 2026

If an employee has just complained about harassment at your small business, the first steps you take matter. Take the complaint seriously, put it in writing, and choose a fair person to review it. Florida law bars employers from discriminating against employees because of protected traits, and the statute’s coverage depends on how many employees you have. This guide walks through the first days after an employee harassment complaint in a small business in Florida, what the law covers, and when to bring in outside counsel. KEW Legal has offices in Coral Gables and Sunny Isles Beach and works with business owners across Miami-Dade and South Florida.

What to Do First When a Harassment Complaint Comes In

Your first job is to treat the complaint as a serious workplace matter, even if it sounds minor or came up in passing.

Acknowledge it in writing. Thank the employee for raising it, say the business will review it, and name the person handling the review. Keep the list of people who know about it short. Share details only with those who need them for the review.

Avoid confronting the accused employee in a way that sounds like a verdict. Don’t punish anyone before you have the facts. A schedule cut or a demotion made too early can look like retaliation, even when the original complaint was weak.

Think carefully about who runs the review. A manager who is close to the accused, or who reports to them, may not be the right person. If the complaint names a senior manager or an owner, plan for outside help from the start.

Avoid writing opinions about the people involved in emails or chat messages. Those messages can be read later by others, including an agency investigator or a court.

If a harassment complaint has just reached your desk and you're weighing an internal review against outside help, we can talk it through with you. Stat. § 760.10).

The protected traits in the statute are race, color, religion, sex, pregnancy, national origin, age, handicap, and marital status. Under the definitions, national origin includes ancestry (Fla. Stat. § 760.02).

Two patterns come up often.

The person doing the conduct can be a supervisor, a co-worker, or a non-employee such as a vendor or customer. Anyone in the workplace can be the person targeted.

A single incident can matter in some cases. Whether conduct crosses the legal line depends on the facts, so write down exactly what happened.

Does the Florida Civil Rights Act Apply to Your Business?

The Florida Civil Rights Act covers an employer with 15 or more employees, and the statute counts those employees in a specific way.

Under Fla. Stat. § 760.02, an employer is a person employing 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year. The definition of person also reaches a partnership and other commercial entities, not only individuals.

The test counts headcount across days and weeks, not a single snapshot. A business that hovers near the line should track its employees over time, not just on the day a complaint arrives.

If you have fewer than 15 employees, the statute may not reach your business. That does not mean the complaint can be ignored. Your own written policy still guides how you respond, and the employee may raise other concerns. A fair, documented response is still the better course.

The statute also directs that it be construed liberally to further its purposes (Fla. Stat. § 760.01).

Step 1: Document the Complaint and Preserve Records

Write the complaint down as the employee described it, as soon as you receive it.

Include the dates, the places, the exact words or conduct, and who else was present. Use the employee’s own words where you can. Then ask the employee to read your summary and point out anything that’s wrong. Note every correction.

Preserve the records that relate to the complaint. That includes emails, text messages, work schedules, timeclock data, performance reviews, and any earlier complaints about the same people. If your phone or email systems delete messages automatically, pause that deletion for the people involved.

Keep every note factual. Leave out opinions, labels, and guesses about motive. A dated file shows what you knew and when you acted.

Step 2: Investigate Fairly and Put Interim Measures in Place

A fair investigation gathers facts from each side and records what it finds, without treating the accused as guilty.

Decide early whether a temporary step is needed while the review runs. Options include changing reporting lines, adjusting schedules, or keeping the two people apart on shifts. Describe these as temporary steps to protect the process, not as punishment.

Pick an investigator who has no personal stake in the outcome. That may be someone outside the chain of command. Explain the process to both the complainant and the accused, including what happens next.

Interview the complainant, the accused, and relevant witnesses one at a time. Ask each person the same core questions.

Write down what each person said, which documents you reviewed, and what you could and could not establish. A gap in the record is easier to fix during the review than after it closes.

Step 3: Act on the Findings and Close the Loop

Your response should follow from what the review found and from your written policy, applied the same way to similar facts.

Corrective steps run across a range. They can include coaching, a written warning, removal from a role, or termination. The right step depends on the facts and your policy. Don’t pick a penalty first and then look for facts to support it.

Florida is an employment-at-will state. Where a job has no set term, either side may end it at any time for any reason (Gessner v. Southern Co.). But an at-will employee may not be fired for a reason the law prohibits, such as retaliation or unlawful discrimination (Laguerre v. Palm Beach Newspapers).

Close the loop in writing. Tell the complainant that the review is finished and that the business took appropriate action. Don’t share confidential details about another employee’s discipline.

Keep a complete file. It should hold the complaint, the investigation, the findings, and the response.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Avoid Retaliation and Prevent the Next Complaint

Punishing someone for raising a concern can create a second problem for your business, even if the original complaint is not supported.

Retaliation is not always a firing. Small employers often miss the quieter forms. These include cut hours, changed assignments, harsher reviews, and comments from managers or co-workers. Each one can look like payback to the person who complained.

Set up clear reporting channels. Give employees more than one way to raise a concern, and say how the business will respond. Keep a written harassment policy, and train managers on what to do when a complaint arrives.

Your handbook matters, but its legal weight is limited. Florida courts generally do not treat handbook policy statements as enforceable contract rights unless the manual says plainly that it is a separate employment contract (Quaker Oats Co. v. Jewell). That does not make your policy optional. It still shapes how you respond, so write it carefully and follow it.

Review the policy as the business grows and as roles change.

When to Bring in Outside Counsel and Your Next Step

Bring in outside counsel when the complaint names a senior manager or owner, when a charge or claim has been filed, or when no one inside the business can review it neutrally.

Timing matters once an agency is involved.
