KEW Legal acts as outside general counsel for business owners and investors across Miami-Dade and South Florida. This page is general information, not legal advice.

What an Employee Complaint Response Covers and Who Needs It

An employee complaint response is the employer’s plan for answering a complaint. It includes the reply the company sends and the steps it takes inside the business. It usually starts when one of three things arrives:

A written internal complaint, such as one about harassment, discrimination, wages or safety.

A demand letter from an employee’s lawyer.

A notice that a charge was filed with the Florida Commission on Human Relations (FCHR) or the U.S. Equal Employment Opportunity Commission (EEOC).

Owners, managers and HR leads often face these moments without in-house counsel. KEW Legal focuses on business and employment matters for employers. Employee issues can be handled alongside contracts, leases and owner disputes. The firm has offices in Coral Gables and Sunny Isles Beach. It serves Miami, Aventura, Doral, Brickell, Fort Lauderdale and Broward County.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What the Response Includes

A complete response starts with a fact review and a plan to keep evidence. Federal laws such as Title VII of the Civil Rights Act may apply alongside Florida law.

Evidence preservation: keeping emails, texts, schedules, performance reviews and policy documents. Deleting routine records during a dispute can create new problems.

Drafting: the written reply to an internal complaint or demand letter, and any position statement an agency requests.

Investigation guidance: whether to investigate internally, how to document it, and how to share the outcome without creating new exposure.

Policy review: anti-harassment, complaint-procedure and anti-retaliation language.

Florida and Federal Rules That May Apply

Florida’s main employment discrimination law is the Florida Civil Rights Act of 1992. It bars an employer from discriminating in hiring, firing or the terms of employment. The grounds include race, color, religion, sex, pregnancy, national origin, age, handicap and marital status. See § 760.10.

Coverage starts at 15 employees. The Act defines an employer as a person employing 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year. See § 760.02. Smaller employers should confirm whether the state law applies to them.

Timing matters. A civil lawsuit under the Act must start no later than one year after the FCHR’s reasonable-cause determination or an EEOC Notice of Right to Sue, whichever comes first. When neither a reasonable-cause determination nor a Notice of Right to Sue issues within 180 days after the complaint is filed, the case may be brought within 18 months after filing. Under § 760.11(8)(c), when the commission notifies the aggrieved person that it failed to conciliate or to determine whether there is reasonable cause, a civil action must be commenced within 1 year after the date the commission certifies that the notice was mailed under § 760.11(8)(b). Federal charge deadlines are set in 42 U.S.C. § 2000e-5, so each agency’s clock needs its own tracking.

Florida is generally an at-will employment state. In Gessner v. Southern Co., the Florida Supreme Court explained that a fired at-will employee must rely on a contractual or statutory exception. A common-law retaliatory discharge claim has never been recognized in Florida. An at-will employee may be let go at any time, but not for a reason the law prohibits, as stated in Laguerre v. Palm Beach Newspapers. Which rule applies depends on the facts.

Handbooks matter too. Under Quaker Oats Co. v. Jewell, policy statements in an employee manual do not create enforceable contract rights. The exception is specific language showing the manual is a separate employment contract.

How the Response Works, Step by Step

The response usually moves through six steps. Timelines vary with the agency and the facts of each case.

First consultation. You review the notice or complaint and any deadlines it carries.

Immediate steps. You preserve documents, pause routine deletions, and keep managers from discussing the complaint with the employee or witnesses outside a planned process.

Fact review. The team gathers the personnel file, prior complaints, witness accounts and policies, and finds gaps early.

Strategy. The employer chooses between an internal investigation, a written reply to the employee’s lawyer, or a position statement to the agency.

Drafting and filing. The reply or agency submission is prepared, with each deadline tracked against its statutory window.

Resolution. The matter moves to settlement talks, corrective action, or preparation to defend a lawsuit if it continues.

Retaliation and Common Missteps to Avoid

Retaliation is often the most avoidable risk in a complaint. Under § 760.10, an employer may not discriminate against a person for opposing a practice the law makes unlawful. The same rule covers a person who made a charge or took part in an investigation or hearing.

Retaliation is not only firing. A demotion, cut hours, changed duties or a sudden negative review after a complaint can all draw scrutiny. Review every employment decision about the person who complained before it takes effect.

Common missteps include:

Sending a reply that nobody has reviewed.

Discussing the complaint with coworkers.

Changing the employee’s duties without written reasons.

Deleting messages or files.

A written complaint procedure, applied the same way every time, helps show how each complaint was received, investigated and resolved. One reviewed channel for all responses keeps managers from creating new exposure.

Why Work With KEW Legal on Employee Complaints

KEW Legal works as an employee complaint response attorney team for Miami-Dade employers and Broward employers. Kristina E. Wilson is the responsible lawyer for this page. She is one of the firm’s lawyers, and the firm’s lawyers focus on business and employment matters.

Because KEW Legal acts as outside general counsel, a complaint can be reviewed alongside a lease, a vendor dispute or an ownership question. That matters when an employee issue touches a partner or a succession plan. The firm’s offices are in Coral Gables and Sunny Isles Beach.

The first consultation is free, confidential, and carries no obligation to continue.

A matter may be referred to another lawyer or firm if that is a better fit.
