Wilson · Published October 24, 2026

Questions about unused vacation pay when an employee leaves depend on the specific facts of each situation. This guide explains how a handbook, an offer letter, or past payouts can create a duty. It also shows how to write a clear rule before anyone resigns or is let go. Kristina E. Wilson is the responsible lawyer for this page at KEW Legal, which has an office in Coral Gables.

The Short Answer: Your Written Promises Usually Decide It

That promise can come from a written policy, a contract, or a steady practice. Each source needs its own look at the documents and the facts.

Florida courts look closely at wording. An express contract that covers a subject generally controls it. A worker cannot use unjust enrichment on the same subject instead, according to Williams v. Johnson.

Your first step is to pull every document that touches vacation. That means the handbook, offer letters, any signed agreements, and payroll records showing what was paid when people left. Gather them before you answer an employee, because the answer depends on what each one says.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Can Create a Payout Obligation

Three sources most often decide the question: the handbook, the offer letter or contract, and past practice.

A handbook is the most common place to find a vacation rule, but it is not always a binding promise. Florida courts hold that policy statements in an employee manual do not create enforceable contract rights unless the manual shows an explicit, mutual agreement that it is a separate employment contract, as stated in Quaker Oats Co. v. Jewell. A handbook line still matters, because it shows what the business told its staff the rule was.

An offer letter or signed employment agreement is usually stronger evidence. If it promises vacation pay on resignation or termination, that is a direct promise to the employee.

Past practice counts too. If the business has paid out unused time every time someone left, employees may point to that pattern as the rule. A sudden change without notice invites dispute.

Mixed signals create the most risk. If the written terms say one thing and the business does another, the employee may rely on the written terms. The dispute will likely center on them.

How One Handbook Sentence Changes the Answer

A single sentence can point the answer in opposite directions.

Compare two lines. “Unused accrued vacation is paid upon separation” tells staff they will be paid. “Unused vacation is forfeited upon separation” tells them they lose the balance. Same employee, same balance, opposite results.

Vague wording creates a different problem. A line saying vacation “may be paid at the company’s discretion” leaves open whether payment was a choice or a promise. The business may read it one way, and a departing employee may read it the other way.

Conflicting sections are common in older handbooks. A payout clause in one chapter and a forfeiture line in another leaves a reader asking which one controls. Read your whole manual, not just the vacation section. That question is what a dispute often ends up being about, and it is easier to prevent than to argue later.

Drafting a Neutral Vacation Rule Before a Separation

Write one vacation rule, in one place, before anyone resigns or is let go.

Start with the mechanics. Explain how vacation accrues, when employees may use it, and whether the balance has a cap. Then state plainly what happens to accrued, unused time at separation: paid, forfeited, or paid only under stated conditions, such as written notice of resignation. Keep that answer in one section so no two parts of the manual disagree.

Apply the rule the same way to every employee and every kind of separation. Uneven application is where disputes often start. Record the date of each change and keep earlier versions on file.

Have each employee sign an acknowledgment when hired and again whenever the policy changes. A signed acknowledgment shows the employee received the rule.

If you plan a forfeiture term, review it with a lawyer before you finalize it. The rules for applying a forfeiture can be technical, and small wording errors can create the disputes you wanted to avoid.

Common Separation Situations and Related Issues

Your policy should answer each kind of exit, not just one.

A resignation with notice raises one question: does the notice period affect payout? Spell out the answer. If the policy ties payment to notice, state what notice is required and what happens if it is not given.

Termination is different. Florida is an employment-at-will state, so either side may end the job at any time, as Gessner v. Southern Co. restates. An at-will employee still cannot be fired for a reason the law prohibits, such as retaliation or unlawful discrimination, as Laguerre v. Palm Beach Newspapers explains. A vacation rule does not change either point, so write it to answer payout, not to decide whether a firing was lawful.

An employee who leaves without notice raises a separate job abandonment question.

Unemployment claims also follow separations. Keep dated written records of the reasons for each separation.

Vacation Payout Disputes and Florida’s Minimum Wage Statute

A former employee’s demand for unused vacation can grow into a formal claim. Vacation pay and minimum wage are separate questions, though.

The minimum wage statute sets out a notice process. Before suing for unpaid minimum wages, the employee must give written notice that identifies the wage claimed, the work dates and hours, and the total unpaid amount. The employer then has 15 calendar days after receipt to pay the total amount of unpaid wages or otherwise resolve the claim to the employee’s satisfaction, under Fla. Stat. § 448.110. A prevailing employee recovers back wages plus the same amount as liquidated damages. A court may reduce those damages if the employer proves good faith and reasonable grounds.

Fees matter too. In an action for unpaid wages, a court may award the prevailing party costs and a reasonable attorney’s fee, per Fla. Stat. § 448.08. That makes a careful early response worth the effort.

When a demand arrives, gather the signed policy, offer letter, payroll records, separation documents, and any emails about the vacation balance. Those documents show what the business owes and what it can prove.

If you’re weighing whether your handbook sentence requires a payout, or you’ve received a former employee’s demand for unused vacation, KEW Legal can review the policy language and the separation facts with you.
