Wilson · Published October 24, 2026

The Short Answer for Florida Employers

Most employee claims against a Florida business rest on a few rules: state discrimination and whistleblower laws, workers’ compensation protections and wage laws. You lower your exposure by keeping written policies, applying them the same way to everyone, and answering complaints quickly and in writing. That is the core of how to protect a Florida business from employee lawsuits.

Company size changes the answer. Florida’s Civil Rights Act applies to employers with 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year. The state’s private whistleblower law reaches private employers with 10 or more. The same conduct can carry different exposure at 8 employees and at 25.

This page walks through the main claim areas in plain terms. It covers at-will employment, discrimination, harassment, wage pay, contractor status, retaliation, documentation, handbooks, filing deadlines and your first response. That rule has a hard limit. Laguerre v. Palm Beach Newspapers explains that an at-will worker can be let go at any time, but not for a reason the law prohibits, such as retaliation or unlawful discrimination.

Other protections come up in everyday decisions. Florida law bars an employer from firing, threatening, intimidating or coercing a worker because of a valid workers’ compensation claim. See Fla. Stat. § 440.205. The discrimination and retaliation rules below also limit when you can end someone’s job.

An at-will label in writing does not end the analysis. What matters is whether your real decisions match the label. If managers end jobs for reasons the file never mentions, the label will not protect you. Check your termination decisions against your actual reasons, and write those reasons down when they happen.

Discrimination Rules for Florida Employers

Florida law makes it unlawful for an employer to fire or refuse to hire someone, or to treat a worker differently in pay or conditions of work. The reason can be race, color, religion, sex, pregnancy, national origin, age, handicap or marital status. The rule appears in Fla. Stat. § 760.10.

The state rule reaches employers with 15 or more employees. Under Fla. Stat. § 760.02, an employer employs 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year.

Prevention starts with consistency. Use the same job criteria for every candidate and every promotion. Write down the reasons for hiring, pay and firing decisions when they happen. Set up a clear process for accommodation requests, and answer each request in writing.

Harassment, Bullying and Hostile Work Environment Claims

That rule is found in Fla. Stat. § 760.10. Conduct tied to race, sex, religion, age or another listed trait is the type that leads to claims.

Bullying that is not tied to a listed trait may not fit that rule. It still creates complaints, turnover and manager problems. Those problems often become the first step toward a claim, so they deserve the same attention.

Good practice starts with a written anti-harassment policy. Give employees more than one way to report a concern, such as a direct manager and a second route above that manager. Investigate promptly, record the outcome, and follow up with the employee who raised the concern. A documented response shows the company took the complaint seriously.

Wage and Hour Claims: Overtime, Final Pay and Overpayments

Florida’s minimum wage law gives workers a set path to recover unpaid wages. Before a worker sues for unpaid minimum wages, the worker must give the employer written notice. The employer then has 15 calendar days after receiving that notice to pay the amount or otherwise resolve the claim. See Fla. Stat. § 448.110.

If the worker wins, the worker recovers the unpaid back wages plus the same amount as liquidated damages (an extra sum equal to the unpaid wages). The worker also recovers reasonable attorney’s fees and costs. The court can reduce the extra amount if the employer proves good faith and reasonable grounds for its pay practice. A separate statute lets the court award the prevailing party in an unpaid wage action costs and a reasonable attorney’s fee. See Fla. Stat. § 448.08.

See 29 C.F.R. 541.600. Keep payroll records that show hours, rates and payments. If you need to recover an overpayment, explain the reason and the amount in writing first.

Employee or Independent Contractor: How Status Is Decided

A contract label alone does not settle whether a worker is an employee or an independent contractor. Florida’s whistleblower law defines an employee as someone who performs services for, and under the control and direction of, an employer for wages. It says the term does not include an independent contractor. See Fla. Stat. § 448.101.

Several questions often decide the issue. Who sets the hours and the methods? Who supplies the tools and equipment? How is the worker paid? Is the work part of the regular business? Your answers to these questions matter more than the words in the agreement.

A mislabeled worker can lead to disputes over pay and benefits. Review each arrangement before onboarding. Review it again whenever the worker’s duties change, because a role that starts as a contractor job can drift toward employee-style control over time.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Retaliation, Whistleblower and Workers’ Comp Protections

Retaliation is a separate claim, and it often follows the first complaint. Florida law makes it unlawful for an employer to discriminate against a person who opposed an unlawful practice. It also covers a person who made a charge or took part in an investigation, proceeding or hearing. See Fla. Stat. § 760.10.

Florida’s private whistleblower law covers private employers with 10 or more persons. It bars retaliatory action against an employee who discloses a violation to a government agency under oath and in writing. See Fla. Stat. § 448.102.

Two details matter here. The disclosure protection applies only if the employee first raised the problem in writing with a supervisor or the employer. The employer must also have a reasonable chance to fix it.

Before any termination, demotion or pay cut that follows a complaint, run a retaliation review. Ask whether the decision has a documented, non-retaliatory reason. Ask whether the same decision would have been made without the complaint.

Discipline, Documentation and Performance Plans

Consistent, dated records of performance and discipline can help an employer explain its decisions. Follow a clear sequence. Note the expectation, the issue you saw, the coaching or warning, the written plan and the result.

Record facts, not opinions. “Arrived after the 9:00 start on March 3 and March 10” is useful. “Bad attitude” is not. Keep records of how similar employees were handled for similar problems. That comparison matters when a worker says the rules were applied unevenly.

Do not fill gaps after a complaint arrives. Records made in the normal course of business are more believable than notes written later to defend a decision. Keep your files current as issues happen, and keep them in one place.

Written Policies, Handbooks and Consistent Practice

A handbook helps only when managers follow it. Florida courts have held that policy statements in an employee manual do not create enforceable contract rights. The exception is when the manual contains specific language showing the parties’ explicit mutual agreement that it is a separate employment contract. See Quaker Oats Co. v. Jewell, 818 So. 2d 574 (Fla. 5th DCA 2002). The exact wording matters.

Core sections usually cover the at-will statement, the anti-harassment policy, the complaint procedure, leave rules and pay practices. Ask each employee to sign an acknowledgment of the handbook. Keep the current version on file, and keep past versions too.

Update the handbook when the rules change. A policy that managers ignore can hurt you when a complaint arrives. It shows the written rule was not applied in practice. Match the handbook to how your business really operates.

Deadlines That Matter After a Claim Is Filed

Florida claims run on specific clocks, and each clock starts at a different point. Under Fla. Stat. § 760.11, the Florida Commission on Human Relations must decide within 180 days of a complaint whether there is reasonable cause to believe discrimination occurred. A civil action must begin no later than 1 year after that determination or the EEOC right-to-sue notice, whichever is earlier. Under Fla. Stat. § 760.11, the 18-month window applies only when the Florida Commission on Human Relations has not made a reasonable-cause determination, or the Equal Employment Opportunity Commission has not issued a Notice of Right to Sue, within 180 days after the complaint is filed. In that situation, the employee’s lawsuit may be started up to 18 months from the date the complaint was filed. Fla. Stat. § 760.11 reads: “The commencement of such action shall divest the commission of jurisdiction of the complaint, except that the commission may intervene in the civil action as a matter of right.”

Under Fla. Stat. § 760.11, if the commission fails to conciliate or determine whether there is reasonable cause and notifies the aggrieved person, a civil action brought by that person must be commenced within 1 year after the date the commission certifies that the notice was mailed. Under section 448.103, the deadline is whichever is earlier: 2 years after the employee discovers the alleged retaliatory personnel action, or 4 years after that action was taken. See Fla. Stat. § 448.103.

Minimum wage claims also run on a short notice clock. The employer has 15 calendar days after written notice to respond, and the limitations period is paused during that window. When a notice or complaint arrives, preserve emails, schedules, pay records and personnel files right away. Missed response dates can narrow your options.

Responding When a Complaint or Charge Arrives and Talking With KEW Legal

The first response should be calm, written and fast.
