If you are asking how many employees before discrimination laws apply Florida, start with that number. Then check the smaller-business rules below, because some Florida laws reach much smaller companies.

Short Answer: Fifteen Employees for the Main Discrimination Laws

The Florida Civil Rights Act covers employers with 15 or more employees. The statute defines an “employer” as a person employing that many workers for each working day in 20 or more calendar weeks in the current or preceding calendar year. It also covers any agent of that person.

Federal laws such as Title VII have their own coverage tests. So the number that matters depends on which law is in question. Smaller businesses still face real employment rules. Some Florida rules reach employers with 10 employees, and one wage rule reaches employers with just two.

If you are hiring, firing, or changing pay and aren't sure which rules now apply to your headcount, we're glad to talk it through with you. It does not look at one headcount snapshot on a single date. The employer needs 15 or more employees for each working day in 20 or more calendar weeks. The statute counts those weeks across the year, so they do not have to form one unbroken run.

The preceding calendar year matters too. Because the test looks back at last year, staffing from the prior year can affect this year’s answer.

Owners often estimate headcount from memory. That is a mistake. Pull payroll records for each month instead. A dated record shows exactly when your count reached the threshold, and it gives you something concrete to check if a question comes up later.

Which Laws Apply at 15 Employees and Above

Under Fla. Stat. § 760.10, an employer may not fire or refuse to hire someone. It also may not treat a worker differently in pay or other terms of work. The reason generally cannot be race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status. For religion, sex, pregnancy, national origin, age, handicap, or marital status, the law allows limited exceptions, including where the trait is a bona fide occupational qualification reasonably necessary for the performance of the particular employment; for handicap, the exception applies where the absence of a particular handicap is that qualification.

Those protected decisions show up in everyday management. Hiring, firing, pay, scheduling, and promotion all count. Each of those decisions can create a problem if it turns on a protected trait. That is why a documented, neutral reason for each decision matters so much.

Pregnancy has its own federal guidance. EEOC pregnancy accommodation guidance

What Smaller Employers Still Face Under Other Laws

Employers below 15 staff are not free of Florida employment law. The Florida Private Whistle-Blower’s Act defines an employer as a private firm that employs ten or more persons.

The wage rule reaches even smaller businesses. Florida’s sex-based wage provision defines an employer as any person with two or more employees. Under Fla. The Florida Civil Rights Act lists those traits in § 760.10. The list includes marital status and handicap, which many owners do not think about.

Retaliation is a separate prohibition. Under the whistle-blower law, an employer may not discharge, suspend, demote, or take other adverse action against an employee for objecting to an illegal practice. § 448.102

Florida’s at-will rule has limits. Records that show how each candidate was evaluated make that reason easier to explain later. Write down the job criteria before interviews begin. Ask every candidate the same core questions.

The EEOC publishes recordkeeping requirements for covered small-business employers. Check those rules before you clear out old hiring files. EEOC recordkeeping requirements

Job ads and interview questions deserve the same care.
