An employee can sue an employer for wages that were earned and never paid. The claim may rest on a state law, on an agreement such as a pay rate, commission plan or bonus promise, or on both.

Many of these disputes start small. One worker says a paycheck came up short, and the issue grows from there. The mix depends on the work, the pay terms and how the worker was classified.

The first is the state minimum wage law. The Florida Minimum Wage Act, Fla. Stat. § 448.110, covers people entitled to the federal minimum wage under the federal Fair Labor Standards Act (FLSA). The state constitution sets the same floor in Article X, section 24. Courts read that amendment with federal FLSA case law as a guide.

Fee exposure comes next. Fla. Stat. § 448.08 lets a court award the prevailing party in an unpaid-wage action costs and a reasonable attorney’s fee.

Agreed pay can support a separate contract claim. A written commission plan or bonus promise sets the terms. The claim turns on what the agreement actually says. Handbook wording works differently. In Quaker Oats Co. v. Jewell, Florida’s Fifth District Court of Appeal held that manual policies don’t create enforceable contract rights unless the manual explicitly says it is a separate employment contract.

Coverage also depends on how the worker was classified. Our guide to employee or independent contractor status explains that question.

What an Employee Can Recover in a Wage Lawsuit

An employee who wins can recover the full amount of unpaid back wages. Under the state minimum wage law, the employee also recovers the same amount again as liquidated damages (an added sum equal to the unpaid wages). The employee also gets reasonable attorney’s fees and costs, as set out in the Florida Minimum Wage Act.

Good faith can change that amount. If the employer proves by a preponderance of the evidence (more likely than not) that its act was in good faith and it had reasonable grounds to believe it was lawful, the court may, in its discretion, award no liquidated damages. It may also award an amount up to the unpaid minimum wages. The employer carries that proof.

A willful violation carries more risk. For a willful violation, the Attorney General may seek a fine of $1,000 per violation, payable to the state, under Article X, section 24. These claims can also proceed as a class action under Rule 1.220 of the Florida Rules of Civil Procedure, but the plaintiffs must prove, by a preponderance of the evidence, the individual identity and individual damages of each class member. One pay practice that affects a group can create exposure for many workers at once.

Unpaid commissions and bonuses work differently. Every situation depends on its own facts and documents.

Filing Deadlines: How Long an Employee Has to Sue

Minimum wage actions are subject to the limitations period specified in Fla. Stat. § 95.11, running from the date the alleged violation occurred.

Before suing for unpaid minimum wages under the state minimum wage law, the worker must notify the employer in writing. The notice must identify the minimum wage claimed, the work dates and hours, and the total unpaid wages through the notice date, per the Florida Minimum Wage Act.

The employer then has 15 calendar days after receiving the notice to pay or otherwise resolve the claim. The limitations period is tolled, or paused, during those 15 days.

Contract claims, such as unpaid commissions, fall under the general limits in Fla. Stat. § 95.11. Those limits depend on whether the agreement was in writing. Which deadline applies depends on the facts.

How Wage Claims Usually Begin

Most wage claims start with a complaint. A worker may raise a pay problem with a manager, send a written demand, or file a complaint with a government agency.

A lawsuit can follow in state or federal court. It may combine several claims at once, such as minimum wage, contract and retaliation claims.

The stage matters. A written notice starts the 15-day period described above. Calendar that date the day the notice arrives. Then pull the payroll records for the period it covers and review them promptly.

Early Steps That Protect the Employer

Start by preserving records. Keep payroll registers, timekeeping data, schedules, pay stubs, commission statements, bonus messages and any written pay agreements. Stop routine deletion of them.

Next, compare time records with pay records for the period in question. Look closely at pre-shift tasks, meetings and after-hours messages. These are the places where unrecorded work often hides.

Handle communications with care. A reply that sounds like pressure can create a second problem. Route all messages about the claim through a documented process.

Calendar every response date in a demand letter or court filing. Missing one can narrow the options that remain.

KEW Legal also works with business owners as outside general counsel. That work can include reviewing pay practices before a dispute begins.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Common Mistakes That Increase Wage Exposure

Four mistakes come up often in pay disputes.

Misclassifying workers. Calling someone a contractor doesn’t settle the question if the working relationship looks like employment.

Shaving time. Rounding or cutting time in ways that always favor the business, or asking staff to work before clock-in, creates the kind of unpaid time these claims are built on.

Retaliation. The Florida Minimum Wage Act makes it unlawful to retaliate against an employee for exercising pay rights. At-will status doesn’t change that. As the court explained in Laguerre v. Palm Beach Newspapers, an at-will employee can’t be fired for a reason the law prohibits, such as retaliation. Our whistleblower guide covers related protections.

Ignoring a demand letter. A missed response leaves the business with no documented position if a suit follows.

Resolving a Wage Dispute Before or After Filing

A wage dispute can be resolved before or after a lawsuit is filed. Common steps include checking the claim against the records, correcting any real underpayment, negotiating terms and answering a complaint within court deadlines.

Put any settlement in writing. Review how it handles back wages, liquidated damages and attorney’s fees before anything is signed. Florida’s general rule is that each party bears its own attorney’s fees unless a contract or statute provides otherwise, as stated in Price v.
