Wilson · Published October 24, 2026

A demand letter from an employee’s lawyer is a formal written claim. It lists what the employee says went wrong, what they want, and the date you must reply by. A measured response tests those claims against your own records, preserves documents, and states your position without admitting liability. Here is what that involves, and which dates to check first.

What an Employee Demand Letter Is and Who This Service Is For

A demand letter asks an employer to pay, change something, or answer by a set date. Most come from a current or former employee’s lawyer. Common claims include unpaid wages or overtime, unpaid commissions, discrimination, harassment, retaliation, and wrongful termination.

Federal rules also apply to employers. The U.S. Equal Employment Opportunity Commission publishes guidance on those anti-discrimination duties. Florida has its own protections too. Under the Florida whistleblower statute, § 448.102, an employer may not retaliate against an employee who objects to certain unlawful practices.

An employee who sues over that kind of objection must prove the practice was actually illegal, not just believed to be. Then check any filing window that may already be running.

Minimum wage claims have a notice step. The worker must first give the employer written notice that names the wage claimed, the work dates and hours, and the total unpaid amount. The employer then has 15 calendar days after receiving the notice to pay the total unpaid wages or otherwise resolve the claim to the worker’s satisfaction. The Florida Commission must decide within 180 days of a complaint whether there is reasonable cause. Under Fla. Stat. § 760.11, when the Florida Commission on Human Relations fails to conciliate or determine whether there is reasonable cause, the commission must promptly notify the aggrieved person, and that notice must inform the aggrieved person that he or she must file a civil action within 1 year after the date the commission certifies that the notice was mailed. Informal words can be quoted back later.

Don’t delete or edit emails, texts, schedules, or personnel files, even ones that look unhelpful.

Don’t retaliate. Florida’s minimum wage law bars adverse action against anyone exercising its rights, so coworkers who support the employee need the same care.

Don’t fire or discipline without counsel review. An at-will employee may be discharged at any time, but not for a reason the law prohibits, such as retaliation.
