So when you ask is my worker an employee or contractor Florida law would recognize, look past the label. Many owners assume the paperwork decides it, and that assumption causes most of the trouble.

Florida does not use just one test. Reemployment assistance covers employment as defined in Fla. Stat. § 440.02 lists conditions under which a worker may be presumed not to be an employee. Examples include holding bank accounts in the business entity’s name to pay business expenses, or being paid on a competitive-bid basis or for completing tasks defined by a contract, unless that contract expressly states that an employment relationship exists.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why the label in the contract does not control

A label is only the starting point. Parties can agree to call someone a contractor.

Some everyday facts point toward an employee, even when a signed agreement says otherwise. The worker keeps a fixed schedule. A manager supervises daily work. The business requires training. The worker is paid a set hourly rate for time on the job.

Florida’s workers’ compensation definition shows the same idea. One criterion for an independent contractor is pay “on a competitive-bid basis or completion of a task,” and that criterion fails if the contract “expressly states that an employment relationship exists.” The contract matters, but only as part of the full picture.

The right to control: how, when, and where the work is done

Instructions on methods, required hours, set locations, and direct supervision all carry weight.

A contractor usually sets their own methods and hours. They are paid for a finished result, not for time on the clock. A landscaper who bids a job, picks the crew, and invoices on completion looks different from a cook who must clock in for a fixed shift.

Owners often say they never really supervise the worker. That view misses part of the picture.

Tools, equipment, and investment in the business

Under Fla. Stat. § 440.02, one listed criterion for independent contractor status is holding one or more bank accounts in the name of the business entity to pay business expenses or other expenses related to services rendered. A worker who brings their own vehicle, equipment, and workspace looks more like a contractor. So does one who pays their own business costs and can earn a profit or take a loss on a job.

The opposite pattern points toward employment. The business furnishes the equipment, uniforms, software, phone, or desk.

Investment shows whether the worker runs a business of their own. Ask whether they have spent real money on equipment, insurance, advertising, or a business name. Ask who pays for materials and who bears the cost when a job goes badly.

A common mistake is to focus on the contract and ignore who owns the truck, the phone, and the software. Those details often tell the story more clearly than the signature does.

Other facts courts and agencies weigh

Pay structure is one clear signal. Hourly or salaried pay and regular paychecks tend to point toward employment. Per-project invoices point toward contracting.

Look at the wider business too. Does the worker serve other clients or offer services to the public as a business? Does the worker hold a business license, liability insurance, or an established business name? Those facts help show independence.

Two more facts matter. Consider whether the work is part of your regular business, and how long the relationship has lasted. Consider also whether either side can end it at will. Florida is an employment-at-will state. Termination rights are one fact to weigh, not the answer on their own.

Why the classification matters to a Florida business owner

Getting the label wrong can cost money. If an employer fails to secure compensation as required, the Department shall assess a penalty “not to exceed $5,000 for each employee” who is classified as an independent contractor but does not meet the § 440.02 criteria (Fla. Stat. § 440.10).

Wage claims add more exposure. Under Florida’s minimum wage law, a worker must give the employer written notice before suing for unpaid minimum wages. The employer then has 15 calendar days to pay or resolve the claim (Fla. Stat. § 448.110). A worker who wins recovers the unpaid back wages plus the same amount as liquidated damages, along with reasonable attorney’s fees and costs. The court may reduce liquidated damages if the employer proves good faith and reasonable grounds.

Florida’s minimum wage amendment also borrows federal terms. “Employer,” “Employee,” and “Wage” carry the meanings under the federal Fair Labor Standards Act (Fla. Const. art. X, § 24). Fees can shift as well. A court may award the prevailing party costs and a reasonable attorney’s fee in an unpaid wage action (Fla. Gather the written agreement, invoices, pay records, and any licenses or insurance the worker holds. Then add schedules, texts or emails that give instructions, and records of any tools or equipment you provided.

Next, write down what actually happens each week. Note who sets the hours, who assigns the work, who checks it, and who pays for materials. Agencies and courts look at day-to-day practice, so your notes should match what really happens, not the template you signed. Record the dates when schedules or pay changed.

Changing an existing worker’s status needs care. Moving a contractor onto payroll raises payroll, tax, and wage questions. Review those before the change, not after a dispute starts. Revisit the review whenever duties, schedules, or pay terms shift.

Frequently asked questions

Short answers to common questions about worker classification follow.

Agencies and courts look at the actual working relationship.

It does not decide the question by itself.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I reclassify an existing contractor as an employee?

You can, but the change brings payroll, tax, and wage questions.
