Wilson · Published October 23, 2026

Employers in Miami-Dade often ask how employment law attorney fees work before they hire anyone. Fees follow the way the work is structured. Most arrangements use a retainer, hourly billing, or a flat fee for a defined project. Here’s how each one works and what to confirm before you agree to anything.

How much do employment law attorneys in Miami-Dade County charge employers for retainers, hourly rates, or flat-fee HR compliance work?

Employment law attorneys in Miami-Dade County usually charge employers in one of three ways: a retainer for ongoing counsel, hourly billing for advice and disputes, or a flat fee for a defined compliance project. Which one fits depends on the facts, mainly the scope of the work.

Employers often compare these options by price alone. A better comparison is what each option covers. Scope is what changes the total.

KEW Legal offers a free, confidential first consultation, with no obligation to continue. The final cost is set in a written fee agreement once the scope is clear. The sections below explain what drives the total in each structure.

If an employee issue or a gap in your policies has you weighing outside counsel right now, we'd be glad to talk through the facts with you first. It fits employers who need regular advice, not a single project. Common questions include hiring, discipline, leave, and handbook updates. Those questions tend to come up month after month.

Under an outside general counsel relationship, the retainer covers that ongoing work. The agreement should spell out what the retainer includes. It should also say what gets billed separately, such as a lawsuit or an agency charge.

Many retainer agreements draw down the balance as work is done. Ask how the balance is reported to you and how often. Get those answers in writing before you pay anything.

How does hourly billing shape the total for employer disputes and advice?

Hourly billing means cost follows the time spent on your matter. It’s common for employee disputes, agency charges, demand letters, and negotiations. The total rises with the work the matter actually needs.

Several tasks add time: reviewing documents, gathering facts, writing analysis, handling correspondence, and meeting with management. A clear question at the start keeps the work narrower. An open-ended dispute with many moving parts takes more hours.

Fee shifting can also matter. Under Fla. Stat. § 448.08, a court may award costs and a reasonable attorney’s fee to the prevailing party in an action for unpaid wages. Under § 57.105, a court must award a reasonable fee when a claim or defense was not supported by the facts, or would not be supported by then-existing law applied to those facts, and the losing party or its lawyer knew or should have known it. No monetary sanction may be awarded on the law ground if the court finds the claim or defense was presented as a good faith argument for the extension, modification, or reversal of existing law or the establishment of new law, with a reasonable expectation of success. That fee is paid in equal amounts by the losing party and its attorney, except that no monetary sanction may be awarded against the losing party’s attorney under the facts or law grounds if he or she acted in good faith, based on the representations of his or her client as to the existence of those material facts. Under the law ground, no sanction may be awarded against a represented party. Fla. Stat. § 57.105 reads: “(d) On the court’s initiative under subsections (1) and (2) unless sanctions are awarded before a voluntary dismissal or settlement of the claims made by or against the party that is, or whose attorneys are, to be sanctioned.”

When does a flat fee fit HR compliance work?

A flat fee fits work with a clear end point. Examples include a handbook review, onboarding documents, a policy update, or a compliance checklist for a set group of employees or locations. When the deliverable is defined, the price can be defined too.

The written scope controls the price. A new complaint from an employee, or an agency inquiry, usually falls outside a handbook project. Under the agreement, that extra work may be billed separately.

Handbook work also needs care. Under Quaker Oats Co. v. Jewell, a Fifth District decision, policy statements in an employee manual generally do not create enforceable contract rights. The exception is specific language showing the manual is a separate employment contract. Decide early what your handbook is meant to do, and write that purpose into the scope.

What should an employer confirm about costs before engaging employment counsel?

Confirm the billing structure first: flat fee, hourly, retainer, or a mix. Ask for the hourly rate of each person who will work on your file. Ask how extra work gets approved before it starts.

Ask about costs outside legal fees, too. Filing fees and third-party charges should be disclosed in advance. You should know everything you may owe before you sign. Put the full list in the written agreement.

Kristina E.
