This guide offers general information about business records.

What records should a Miami-Dade employer preserve, such as personnel files, written policies, and performance reviews, to defend against discrimination or wage claims?

Keep a dated personnel file for every employee, along with the written policies in force at the time, performance and discipline records, and payroll and timekeeping records. These records show what was decided, when, and why.

A personnel file usually holds the application and offer letter, the job description, signed policy acknowledgments, pay change notices, performance reviews, discipline notices, training records, accommodation requests and responses, and any complaint or investigation records.

Write down decisions and their stated reasons when they happen. A note made on the day of a pay change or a write-up is easier to explain than a summary rebuilt months later, after a dispute has started.

Keep medical information out of the general file. Store it in a separate confidential file so supervisors see only what they need to know.

Florida law makes it unlawful to discriminate in pay, terms, or conditions of work because of race, sex, age, handicap, or other listed traits. Your file should show that the same standards applied to everyone.

If a complaint or demand letter has just arrived and you're unsure which records to protect, our team can talk it through with you. Keep every version with its effective date, so you can show which rule applied on the day of a decision.

Old versions matter as much as the current one. If a decision was made under last year’s leave policy, that older version is the one a reviewer needs to see.

Keep signed or electronically logged acknowledgments for each employee. Record the date each person received each version.

Handbook wording matters too. Florida courts have held that policy statements in an employment manual generally do not create enforceable contract rights. The exception is a manual that says, in specific words, that it is a separate employment contract. Quaker Oats Co. v. Jewell Treat a handbook as proof of how your business runs, not as a promise that locks in every term.

A policy that exists on paper but is never followed, or is applied unevenly, loses value as a defense. Keep records showing how each policy was applied, including the discipline that followed it.

How should performance reviews and discipline be documented so they hold up?

Document each review and disciplinary step with dated, specific notes tied to job-related standards. Apply the same standards to comparable employees, and keep proof of it.

Vague notes such as “bad attitude” give a reviewer little to test. Specific notes name the task, the standard, the date, and what happened.

Reviews written after a dispute starts create problems. A review that looks written after a complaint can seem like a reaction to it, even if that was not the intent. Keep drafts and final versions, and note who reviewed and approved each one.

Reasons for pay, promotion, and termination belong in the same file. An at-will employee can be let go at any time, but not in retaliation for exercising minimum wage rights protected under s. 24, Art. X of the State Constitution, such as filing a complaint about unpaid wages (Fla. Stat. § 448.110). Laguerre v. Palm Beach Newspapers, Inc. Records that show a lawful, documented reason are the ones that help.

What payroll and timekeeping records does a Miami-Dade employer need for wage claims?

Keep accurate records of hours worked, pay rates, deductions, overtime calculations, and pay stubs for every employee. Keep original time records, and log any edits, including who made them and when.

Florida’s minimum wage law sets a process before a lawsuit. The worker must give written notice that identifies the minimum wage claimed, the work dates and hours, and the total unpaid amount. Fla. Stat. § 448.110 The employer then has 15 calendar days after receiving the notice to pay or resolve the claim. Records that match the notice make that window easier to use.

If the employee wins, the employee recovers the unpaid wages plus the same amount as liquidated damages, meaning an extra amount equal to the wages owed, and is also awarded reasonable attorney’s fees and costs. A court may, in its discretion, reduce that extra amount to none or to no more than the unpaid wages if the employer proves by a preponderance of the evidence that its act or omission was in good faith and that it had reasonable grounds for believing it was not a violation.

Fla. Const. art. X, § 24 Keep payroll records long enough to cover that full period.

Covered employers must post the state minimum wage poster in each place where employees work. Keep dated proof that the poster is up.

What changes once an employee complaint, charge, or demand letter arrives?

Once a complaint, charge, or demand letter arrives, stop routine deletion and preserve the file as it stands. Nobody should delete, edit, or add to the relevant records without a clear plan.

The first days usually involve these steps:

Suspend automatic deletion of email, texts, and chat messages for the people involved.

Ask managers to keep their notes and any drafts.

Leave the personnel file as it is. Do not add back-dated notes or remove documents.

List where each type of record lives, so nothing is missed.

Editing a file, adding notes with an earlier date, or quietly removing a document can hurt your position in the dispute.

Timing matters. A complaint under Florida’s civil rights law can be filed within 365 days of the alleged violation. Records from a year ago may still be at issue.

Employers who receive a concern about a workplace practice can contact KEW Legal to discuss their options. An employer may not take retaliatory personnel action against an employee who objects to, or refuses to participate in, a practice of the employer that violates a law, rule, or regulation. Gessner v. Southern Co.

How should Miami-Dade employers organize and store employment records?

Keep employment records in one controlled system, with access limited to HR and counsel. Log who views or changes each file.

Keep sensitive information apart from general files. That includes medical records, Form I-9 and eligibility documents, and benefits details.

Florida requires employers to verify each new employee’s eligibility within 3 business days after the employee starts work. Employers must keep the documentation for at least 3 years. If the E-Verify system is unavailable for 3 business days after the first day that the new employee begins working for pay and the employer cannot access the system to verify that new employee’s employment eligibility, the employer must use the Employment Eligibility Verification form (Form I-9) to verify employment eligibility, and it must document the unavailability by retaining a screenshot from each day showing its lack of access to the system, a public announcement that the E-Verify system is not available, or any other communication or notice it recorded about the unavailability of the system (Fla. Stat. § 448.095).

Keep records retrievable after employees leave or systems change. Check that backups can actually be restored.

Florida also requires employers to post a civil rights notice in conspicuous places. For federal rules on personnel records, the EEOC recordkeeping requirements page is a useful reference.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talking through your records with KEW Legal

A manager or owner who has just received a complaint, a charge notice, or a demand letter often has to decide quickly which files to protect.
