Most claims start with a filing deadline, may move through a state or federal agency, and can end up in court. This guide walks through each stage in order. KEW Legal is a business law firm with offices in Coral Gables and Sunny Isles Beach, and it handles employment matters for employers. Responsible attorney for this page: Kristina E. Wilson.

How long does it typically take to resolve a discrimination or wrongful termination claim against a Florida employer?

A claim usually moves through a filing deadline, an agency stage, and sometimes a lawsuit. The total time varies widely and depends on the facts of each matter and the forum where it is heard.

The clock often starts on the date of the firing or the act you believe was unlawful. It does not wait until you fully understand the claim. That is why early attention matters.

Under the Fourth District’s ruling in Laguerre v. Palm Beach Newspapers, an at-will employee may be fired at any time. But the firing cannot rest on a reason the law prohibits, such as retaliation or unlawful discrimination.

The sections below cover the filing deadlines, the agency stage, the lawsuit stage, and the factors that change timing.

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What filing deadlines start the clock on a Florida discrimination or termination claim?

The Fla. Stat. § 448.103 whistle-blower deadline runs from discovery of the action (2 years) or from the action (4 years), whichever is earlier.

Whistle-blower claims run on a different clock. Under Fla. Stat. § 448.103, an employee may sue within 2 years after discovering the retaliatory action, or within 4 years after it was taken, whichever is earlier.

Missing a deadline can end a claim. Write down the date of the firing or the act today. Count forward from that date and track the earliest deadline first.

How long does the agency stage of a discrimination charge usually last?

The agency stage has no fixed length. It runs from intake through investigation to a decision or a right-to-sue notice, and the time varies from case to case.

A typical path looks like this. When a charge is filed, the agency notifies the employer. The parties may try mediation. The agency investigates, often using written responses and documents from the employer. Then it issues a determination or a notice.

The employer’s written response and document production often shape how long the investigation runs. Slow records or incomplete answers can add time.

If the state commission finds reasonable cause, you may bring a civil action in any court of competent jurisdiction. Under Fla. Stat. § 760.11, that suit must start no later than 1 year after the reasonable-cause determination or the EEOC’s Notice of Right to Sue, whichever is earlier. If no determination or notice issues within 180 days after the complaint, suit may start no later than 18 months after filing.

After an EEOC right-to-sue notice, a civil action under Fla. Stat. § 760.11 shall be commenced no later than 1 year after the date of determination of reasonable cause by the commission or the issuance of a Notice of Right to Sue by the Equal Employment Opportunity Commission, whichever is earlier. Check the dates on the notice itself.

How does a lawsuit change the timeline for a wrongful termination claim?

A lawsuit usually moves through the complaint, the employer’s response, discovery, motions, and trial if the case does not resolve earlier. Discovery, where both sides exchange documents and take depositions, is often the longest stage.

Federal court and state court can follow different schedules. The court you use can change the timing.

Damages also matter. Under Fla. Stat. § 760.11, a court may award compensatory damages, including damages for mental anguish. It may also award punitive damages, but total punitive damages under that section are capped at $100,000. The right to a jury trial is preserved when compensatory or punitive damages are sought. Fla. Stat. § 760.11 reads: “The commission’s determination of reasonable cause is not admissible into evidence in any civil proceeding, including any hearing or trial, except to establish for the court the right to maintain the private right of action.”

Remedies differ under the whistle-blower law. Under Fla. Stat. § 448.104, a court may award reasonable attorney’s fees, court costs, and expenses to the prevailing party.

Proof also shapes the case.

Many employment disputes settle at some point. Settlement timing cannot be predicted in advance.

What can speed up or slow down the timeline, and what should you do now?

The main timing factors are the type of claim, whether more than one claim is filed together, whether an appeal follows, and how quickly records are produced. Act on the earliest deadline first.

Start these steps now:

Save texts, emails, performance reviews, pay records, and work schedules.

Write a dated timeline of events while memories are fresh.

Write down every deadline. Don’t rely on memory or a coworker’s account of dates.

Frequently asked questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long do I have to file a discrimination charge in Florida?

Deadlines depend on the facts of each situation, so it is important to raise the question with a lawyer promptly.
