Wilson · Published October 22, 2026

How long does a Miami-Dade workplace dispute take to resolve through an agency charge, mediation, or state or federal court litigation?

There is no single timeline. A workplace dispute in Miami-Dade can move through an agency charge, mediation, and a lawsuit, and these stages can run one after another or overlap. How long each stage takes depends on the facts of the dispute.

Employers usually face one of three tracks. The first is an administrative charge filed with the U.S. Equal Employment Opportunity Commission (EEOC) or the Florida Commission on Human Relations. The second is mediation, which the parties can agree to. The third is a lawsuit in Florida circuit court or in the U.S. District Court for the Southern District of Florida.

A charge that settles early can end the matter before any lawsuit is filed. A charge that moves to a notice of right to sue opens a separate court deadline, so the calendar can change quickly.

If an agency charge or demand letter just arrived and the dates feel unclear, we're glad to walk through them with you. Missing a deadline can limit or end a claim, so write down the date every charge, notice, and demand letter arrives.

Filing deadlines for discrimination charges with the EEOC can be strict, so timing matters. Florida has its own law, the Florida Civil Rights Act, which the Florida Commission on Human Relations enforces.

Under Fla. Stat. § 760.11, a civil action under the Florida Civil Rights Act must be commenced no later than 1 year after the Commission’s reasonable-cause determination or the EEOC’s Notice of Right to Sue, whichever is earlier. If the Commission instead sends notice that it failed to conciliate or to determine whether there is reasonable cause, the action must be commenced within 1 year after the date the Commission certifies that notice was mailed. If neither happens within 180 days after the complaint is filed, the action may start no later than 18 months after filing. Fla. Stat. § 760.11 reads: “The commencement of such action shall divest the commission of jurisdiction of the complaint, except that the commission may intervene in the civil action as a matter of right.”

How long does the agency charge process usually run at the EEOC and the Florida Commission on Human Relations?

An agency charge usually moves through notice, a written response, an investigation, and a decision. No fixed length applies. The employer receives notice of the charge and must send a written position statement by the date stated in the agency’s notice.

The investigation’s length varies with the number of witnesses, the documents requested, the complexity of the claim, and the agency’s workload. A determination can lead to conciliation, a right-to-sue notice, or dismissal. Each outcome starts a different next step on the calendar.

Respond by the date in every agency request. Late replies can extend the timeline or weaken the employer’s position. Retaliation adds risk, too. Under Fla. Stat. § 760.10(7), an employer may not discriminate against someone for opposing an unlawful employment practice, or for filing a charge, testifying, assisting, or participating in any manner in an investigation, proceeding, or hearing under this section.

How long does mediation take compared with litigation in Miami-Dade state and federal courts?

Mediation is often the quicker path, because the parties choose when to meet. A lawsuit usually takes longer. Mediation’s length depends on how fast the parties share information and how willing they are to settle. No set number of days applies.

In a filed civil action for money damages, a court must refer the case to mediation on one party’s request. The requesting party must be able to pay, or the costs must be divided fairly. Court-ordered mediation begins when the court issues an order. Court-ordered mediation ends when the parties sign a settlement agreement intended to resolve the dispute (and, where the law requires, the court approves it), when the mediator declares an impasse, or when the court terminates the mediation.

A lawsuit adds stages: pleadings, discovery, motions, pretrial preparation, and trial. Appeals can follow a final judgment. These stages commonly take longer than an agency charge or a private mediation. Fee rules also matter.

How can an employer keep a workplace dispute on schedule, and when should a Miami-Dade business call an employment lawyer?

Keeping on schedule starts with a calendar and a records file. Write down each agency or court date the day you receive it. Preserve emails, personnel files, schedules, and pay records. Avoid discussing the dispute with the employee outside counsel’s review.

Early review matters. The position statement, the response date, and any mediation offer each shape the timeline.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is mediation in a Miami-Dade employment case confidential?

Generally yes.
