Employment litigation means fighting the claim in an agency proceeding or a court.

Resolution usually starts with a written response to a demand letter. The parties may then try mediation, where a neutral third party helps both sides talk through a settlement. If that fails, the claim can move to a court or stay in an agency process.

This page is for owners, executives, and HR leaders at Miami-Dade and Broward companies. You may have just received a demand letter, an agency charge, or a lawsuit. You may also be dealing with a worker who left and may have taken clients or information.

The first weeks matter. Deadlines can start running when a notice arrives, and early written statements can limit later options.

KEW Legal represents employers. It does not represent employees in these disputes.

Employee Disputes We Handle for Miami-Dade Employers

Employee disputes usually fall into a few groups. These include retaliation, discrimination, wages, confidentiality, and separation terms.

Wrongful termination and retaliation. An at-will employee can be let go at any time. The termination cannot be for a reason the law prohibits, such as retaliation or unlawful discrimination, as Laguerre v. Palm Beach Newspapers explains. Internal complaints and investigations can also lead to retaliation claims.

Discrimination and harassment charges. The Florida Civil Rights Act makes it unlawful for an employer to discharge or discriminate against someone for race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status. Charges can be filed with the EEOC or the Florida Commission on Human Relations.

Retaliation for complaints. The same statute also bars punishing a worker for opposing a prohibited practice or taking part in a charge or investigation. Florida’s whistle-blower law protects employees who object to a violation of law, but under Fla. Stat. § 448.103 an employee may not recover if he or she failed to give the employer the notice required by s. 448.102(1), or if the action was based on a ground other than the employee’s exercise of a protected right.

Wage disputes. Florida’s minimum wage reaches $15.00 per hour on September 30, 2026, under the Florida minimum wage provision.

Non-competes and confidentiality. A court will not enforce a restrictive covenant unless it is in a writing signed by the person bound.

Handbooks and separation terms. Handbook statements usually do not create contract rights. Quaker Oats Co. v. Jewell requires specific language showing the manual is a separate employment contract. Separation agreements and final pay also raise disputes.

How a Matter Moves From First Call to Resolution

A matter usually moves from consultation to document review, a written response, negotiation or mediation, and then litigation only if needed. Timelines vary with the claim type, the agency process, and the court’s schedule.

Initial consultation. The first consultation is free, confidential, and comes with no obligation to continue. We review the claim and the key facts.

Document review. We look at policies, personnel files, communications, and pay records.

Early response. We identify deadlines for the demand letter, agency charge, or complaint. For discrimination claims under Florida law, a civil action generally must begin within 1 year after a reasonable-cause determination or a federal right-to-sue notice, whichever comes first. If neither is issued within 180 days after the complaint is filed, the action may be begun no later than 18 months after the complaint is filed.

Negotiation. Many matters resolve through talks with the other side.

Mediation. If the matter goes that route, a mediator helps the parties work toward terms.

Litigation. If no resolution is reached, the case may move forward in court, with discovery and motion practice.

Resolution Paths and When Each Fits

The main paths are negotiation, mediation, an agency response, litigation defense, and settlement. Choosing a path depends on the facts of the claim, the documents available, and the company’s goals.

Written response to a demand. A clear reply can narrow the dispute and set the facts early.

Mediation. A structured settlement conference with a neutral mediator.

Agency stage. A charge has a filing deadline. EEOC charge-filing guidance explains how discrimination charges are filed with the agency.

Litigation defense. Pleadings, discovery, depositions, and trial preparation. Under Florida’s civil rights law, a court may award back pay. A court may also award compensatory damages, and punitive damages are capped at $100,000 per aggrieved person.

Settlement agreements. Confidentiality and release terms are reviewed for enforceability before the business signs.

Steps Employers Can Take Now If a Claim Has Arrived

Start by preserving records, sending the notice to counsel, and noting the first deadline. Each step keeps the company’s options open.

Keep all relevant emails, texts, schedules, and personnel records. Don’t delete or change them.

Avoid informal talks with the employee about the claim. Retaliation can create a new claim. The Miami-Dade County guidance on retaliation describes adverse action taken for protected activity.

Send the demand letter or agency notice to counsel right away, and write down any response date.

Gather written policies, handbook acknowledgments, and prior complaints or warnings.

Limit internal discussion to people who need to know.

Note the time limit for retaliation under Florida’s whistle-blower law. The employee generally has 2 years after discovering the action or 4 years after it was taken, whichever is earlier, under Fla.
