Managers and employees work from the same playbook. It is different from an offer letter or a signed agreement, which are individual documents for one person.

Florida courts give handbooks limited legal weight. Policy statements in an employment manual generally do not create enforceable contract rights. The exception is when the manual uses specific language showing it is a separate employment contract. Quaker Oats Co. v. Jewell states this rule.

That means a handbook is not a substitute for a non-compete or confidentiality agreement. Those documents need their own signed terms.

This guide is written for owners, managers, and HR leads in Coral Gables, Miami-Dade, and Broward County. You may have no handbook, an outdated one, or a copied template that doesn’t match how your business runs.

What a Florida employee handbook should cover

A strong handbook covers at-will status, equal opportunity, pay and hours, leave, conduct, technology, and signed acknowledgments. Each section should describe what your business actually does.

At-will status. Florida is an at-will state. Gessner v. Southern Co. (Fla. 2026) restates that either side may end an indefinite job at any time. The statement still has limits. An employee can’t be fired for a reason the law prohibits, such as retaliation or unlawful discrimination, as Laguerre v. Palm Beach Newspapers explains. Write the at-will statement so no other section contradicts it.

The Florida Civil Rights Act defines an employer as a person employing 15 or more employees for each working day in 20 or more calendar weeks in the current or preceding calendar year, and any agent of such a person. The first consultation is where the scope and timeline are set.

Intake. We review your current documents, job categories, pay practices, locations, and recent employee issues.

Gap analysis. We identify missing policies, conflicting provisions, and language that does not match how the business operates.

Drafting. Policies are written in plain language. Managers can apply them, and employees can understand them.

Owner and manager review. You review the drafts and confirm operational details. We revise for accuracy.

Rollout. The handbook is issued, signed acknowledgments are collected, and supervisors are briefed on key policies.

Maintenance. We schedule periodic reviews. Updates follow when laws change or the business adds locations, roles, or policies.

The timeline depends on the size of your workforce and the number of policies involved.

Why employers in South Florida work with KEW Legal on policies

KEW Legal serves as outside general counsel for business owners and investors across Miami-Dade and South Florida. Its employment work for employers includes handbooks and policy drafting. Policies are reviewed alongside the advice you may need on contracts, disputes, and separations.

Kristina E. Wilson is the responsible lawyer for this page. The firm’s lawyers, including Natalie Martinez, draft and review policies with the client’s operations in view. Our team starts with your documents, not a generic template.

A template cannot know your pay structures, exempt classifications, remote staff, or locations across Miami-Dade and Broward. Mismatched policies can create confusion when a dispute arises.

Retaliation is another reason accurate policies matter. Under Fla. Stat. § 448.102, an employer may not take retaliatory action against an employee who objects to a practice that violates a law, rule, or regulation. The disclosure protection in Fla. Stat. § 448.102 carries its own condition: it does not apply unless the employee has, in writing, brought the activity, policy, or practice to the attention of a supervisor or the employer and has afforded the employer a reasonable opportunity to correct the activity, policy, or practice. Under Fla. Stat. § 448.102(3), an employee is protected from retaliation for objecting to, or refusing to participate in, an employer’s activity, policy, or practice that violates a law, rule, or regulation. Clear reporting procedures give your business a way to hear concerns early.

Common questions about employee handbooks in Florida

A consultation can show which policies your business needs.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can we use a template from the internet?

Templates rarely match your pay practices, leave rules, or locations.
