The same lawyer represents the business when a complaint, demand or agency charge follows. If you’re looking for a labor law attorney near me, KEW Legal serves Florida employers from offices in Coral Gables and Sunny Isles Beach. This page explains the employer-side work, the Florida laws that often drive it, and how to get started.

What a Labor Law Attorney Does for Florida Employers

A labor law attorney who works for employers helps a business follow workplace rules and handle disputes with its workers. Labor and employment law covers pay, hiring, firing, leave, complaints and the agreements a business signs with its staff. Most of this work falls into two groups.

Reactive counsel starts after something happens. An employee sends a demand letter, files a complaint, or a government agency sends a charge. The lawyer reviews the documents and the timeline, then helps the business respond.

Proactive counsel starts before a problem exists. The lawyer reviews pay practices, handbook language, offer letters and signed agreements, so gaps get fixed early. Changing a policy on a calm day is easier than changing it during a lawsuit.

KEW Legal’s employment work is on the employer side. The firm advises business owners and companies on that side of the table.

If an employee has just filed a complaint or a demand letter has arrived, you don't have to work out the next step alone, so reach out to our team to talk through the facts. The most common issues include:

Wage and hour and overtime questions

Harassment complaints and agency charges

Termination decisions and wrongful termination claims

Independent contractor classification

Non-compete, non-solicitation and arbitration agreements

Workers’ compensation claims

Records retention and personnel files

Outside general counsel is a different kind of help. A business with regular staffing or policy questions may want one lawyer it can call before a problem grows. Under that arrangement, the lawyer becomes a steady point of contact for the business’s legal questions, employment matters included. More detail on each issue appears in related pages on this site.

Wage and Hour and Overtime Questions

Pay disputes are among the most common employer problems, and they often turn on records. Under Fla. Stat. § 448.110, the Department of Commerce calculates an adjusted state minimum wage rate annually on September 30 by increasing the state minimum wage by the rate of inflation for the 12 months prior to September 1, and each adjusted rate takes effect on the following January 1. See the Florida minimum wage provision for the text.

If an employer fails to pay the minimum wage, a worker who wins can recover unpaid back wages. The worker also recovers the same amount as liquidated damages, which is an extra sum added to the back pay, unless the employer proves good faith and reasonable grounds, in which case the court may, in its sound discretion, award no liquidated damages or award any amount thereof not to exceed an amount equal to the amount of unpaid minimum wages. The worker can also recover reasonable attorney’s fees and costs.

The Florida minimum wage statute lets a court reduce or drop liquidated damages in some cases. The employer must show good faith and reasonable grounds for believing its act was lawful.

In an action for unpaid wages, the Florida wage fee statute lets the court award the prevailing party costs and a reasonable attorney’s fee. Whether a particular worker is owed overtime turns on the facts of that job. Accurate time and pay records are the first thing a lawyer reviews.

Responding to Harassment Complaints and EEOC Charges

The first step after an internal harassment complaint is to document it. Write down who reported what, when, and who was present. Preserve emails, messages, schedules and any earlier complaints. An internal review done with counsel protects the employee who complained and the business.

Florida law bars an employer from discriminating in pay, terms or conditions of work because of listed traits such as sex, race, age, or handicap. The same law bars retaliation against a person who opposed a practice or took part in a charge or investigation. See the Florida Civil Rights employment statute. Retaliation is a separate violation, so a response must be handled carefully.

Complaints filed with the Florida Commission on Human Relations that identify a person are confidential. They can be shared with the parties or in a hearing or proceeding. The Florida Civil Rights remedies statute also sets the deadline for a civil lawsuit. The suit must start within one year after a reasonable-cause determination or a federal Notice of Right to Sue, whichever is earlier; if neither is issued within 180 days after the complaint is filed, the suit must start no later than 18 months after the complaint is filed. Fla. Stat. § 760.11 reads: “The commencement of such action shall divest the commission of jurisdiction of the complaint, except that the commission may intervene in the civil action as a matter of right.”

Under that statute, punitive damages to one person can’t exceed $100,000. A jury trial right is preserved when compensatory or punitive damages are sought. Fla. Stat. § 760.11 reads: “The commission’s determination of reasonable cause is not admissible into evidence in any civil proceeding, including any hearing or trial, except to establish for the court the right to maintain the private right of action.” Counsel can help the employer check the facts, review the documents, and keep any response consistent with the records.

Termination Decisions and Wrongful Termination Claims

Florida hiring is generally at will. An at-will employee may be discharged at any time, but not for a reason the law prohibits, such as retaliation or unlawful discrimination. The Florida appellate decision in Laguerre states this rule.

Before a termination, review the documented reason, the timeline and the personnel file. Ask whether the employee recently complained, reported an injury, or objected to a practice. The Florida whistle-blower statute bars retaliation against an employee who objects to or refuses to join a practice that violates a law. Under Fla. Stat. § 448.102(3), an employer may not take any retaliatory personnel action against an employee because the employee has objected to, or refused to participate in, any activity, policy, or practice of the employer which is in violation of a law, rule, or regulation. Fla. Stat. § 448.102(1), which covers an employee who disclosed, or threatened to disclose, a violation to an appropriate governmental agency, under oath, in writing, reads: “However, this subsection does not apply unless the employee has, in writing, brought the activity, policy, or practice to the attention of a supervisor or the employer and has afforded the employer a reasonable opportunity to correct the activity, policy, or practice.”

A handbook does not automatically create a contract. In Florida, a policy statement becomes a contract only if it contains specific language showing the parties explicitly agreed it is a separate employment contract, as the Quaker Oats decision explains.

When a former employee brings a wrongful termination claim, counsel gathers personnel records, emails and other evidence. Preserving those materials early is part of the defense.

Independent Contractor Classification and Misclassification Review

A contract that calls a worker an independent contractor doesn’t settle the question on its own. The working relationship matters more than the label. Who sets the hours, who controls how the work is done, how the worker is paid, and whether the work is part of the regular business all matter.

A misclassification review looks at these facts and at how the work is actually done day to day. Employers often find that the paperwork describes one arrangement while daily practice looks like another. Fixing that gap early is usually simpler than fixing it after a claim.

If a review finds problems, counsel can help the business change the arrangement going forward and plan the next steps carefully. Related pages on this site cover contractor classification in more detail.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Non-Compete, Non-Solicitation, and Arbitration Agreements

Florida courts will enforce a restrictive covenant only if it is in a writing signed by the person against whom enforcement is sought. The Florida restrictive covenant statute also requires the party seeking enforcement to show a legitimate business interest. Examples include trade secrets and customer goodwill.

That party must also show the restraint is reasonably necessary to protect that interest. If the restraint is overbroad, overlong or otherwise not reasonably necessary, the court must modify it. The court then grants only the relief reasonably necessary. Courts construe these covenants to protect legitimate business interests, not narrowly against the restraint.

Covered noncompete agreements follow a separate framework. The 2025 covered noncompete statute ties enforceability to written advice of the employee’s right to seek counsel and specific notice, the employee’s written acknowledgment that they will receive confidential information or customer relationships, and a term reducing the noncompete period day-for-day by any nonworking part of a garden leave notice period, if applicable. Employers should confirm which framework applies before relying on an agreement.

A written arbitration agreement is generally valid and enforceable. The Florida arbitration statute makes it so, except on a ground that exists to revoke a contract. A court also decides whether an agreement to arbitrate exists. Under the statute, an arbitration agreement may be revoked on any ground that exists at law or in equity for the revocation of a contract; as the Florida Supreme Court in Basulto explained, courts have treated unfair terms as unenforceable where procedural and substantive unfairness are both present.

Workers’ Compensation Claims from the Employer Side

Any employer who has employees engaged in work in Florida must obtain a Florida policy or endorsement that utilizes Florida class codes, rates, rules, and manuals, and failure to comply is a felony of the second degree. The Florida workers’ compensation liability statute makes failure to comply a felony of the second degree.

An employer may not discharge, threaten, intimidate or coerce an employee because of a valid workers’ compensation claim or an attempt to claim benefits. The Florida coercion statute says so directly. Workplace decisions made after an injury report deserve extra care.

When an injury is reported, the business should document it promptly and keep its records consistent. Counsel can help coordinate with the insurance carrier and review the employer’s response before it goes out.

Records Retention and Personnel Files

Keep payroll, personnel, complaint and training records organized and easy to find. A clear file makes it much easier to build a timeline when a question arises. Retention periods depend on the record type and the law that applies to it.

Signed restrictive covenants, arbitration agreements and handbook acknowledgments belong in the personnel file. Florida requires a signed writing for many restrictive covenants, so the signed copy matters.

When a dispute is reasonably anticipated, the business should preserve relevant records. That includes emails, texts, schedules and personnel files. Routine deletion should stop for those materials. Counsel can help set up this step, often called a litigation hold.

Serving Miami-Dade, Coral Gables, and Sunny Isles Beach

KEW Legal is a Florida business law firm with offices in Coral Gables and Sunny Isles Beach.
