It fits when it matches the complexity of the work, the local market for business lawyers, and the lawyer’s experience. Rates vary by city, practice area, and experience. The same number can be ordinary for a multi-party dispute and high for a short letter. The rate also doesn’t show your total cost. That total depends on how many hours the work takes. Five hours at $400 is a very different bill from fifty hours at the same rate. Whether $400 is a lot depends on the facts of your matter.

What the headline numbers about $3,400 an hour actually mean

You can read the ABA Journal report for the full details.

Those figures describe a small group of high-billing national firms. They don’t describe the typical rate for a business contract, a vendor dispute, or a commercial lease matter. Set side by side, $400 sits well below that headline number. That comparison tells you little about whether the rate fits your matter. News about extreme rates shows where the market can reach. It doesn’t set the rate for your case.

What does an hourly rate pay for?

An hourly rate pays for the lawyer’s time on your matter. That time can include client calls, reading contracts and leases, legal research, and drafting or reviewing notices and agreements. It can also include talking with the other side’s lawyer and appearing at mediation or in court when the matter requires it.

The rate also covers the cost of running a practice. Office space, support staff, insurance, and technology all add to that cost. Florida law recognizes that support work counts toward fees. Under Fla. Stat. § 57.104, when a court determines or awards attorney fees, it considers the time of legal assistants who give nonclerical, meaningful legal support under a lawyer’s supervision.

A higher rate often reflects years of practice and the ability to handle complex or high-dollar business matters. A rate alone doesn’t prove the quality of the work. Ask who will do each task and what each person charges.

How does hourly billing add up over a matter?

Hourly bills grow with each step. Here’s a simple example. Suppose a vendor dispute takes three hours to review the contract and send a demand letter. Add four hours for a response and two hours of client calls.

The early hours matter because they set the path for the rest of the work. Many firms bill in small time increments. A short call or a quick email can show up as billed time. Ask how calls, emails, and internal review are recorded.

Detailed time records also matter if a case reaches a judge. In certain consumer-protection lawsuits, the winning side’s lawyer must file a sworn affidavit of time spent and costs. The judge may then award a reasonable fee for the hours actually spent, as shown in that affidavit. See Fla. Stat. § 501.2105.

Hourly, flat fee, retainer, or contingency: how is the bill structured?

An hourly fee charges for each hour worked. A flat fee sets one price for defined work, such as reviewing a single lease. An attorney retainer is an advance deposit. The lawyer applies it against billed time, and it may need to be replenished.

A contingency fee ties payment to a recovery. It is less common in many commercial contract and lease matters than in other types of cases.

Separate costs can be owed in addition to the lawyer’s time. These may include filing fees, service of process, court reporter fees, and charges from outside consultants or witnesses. Ask which costs apply and how each one will be billed. Ask which structure applies to your matter and what other costs may be added.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What makes a rate reasonable for the work?

The hours and the stakes drive the value of the work. A vendor breach with a near deadline, a partner dispute with a lot at stake, or a commercial eviction with a possession timeline can make quick, focused work worth more. A short matter with a clear question may cost less in total than a longer engagement at a lower rate. The reverse can also be true. The estimate tells you more than the rate alone.

Florida courts also use a formula. In any action where a court determines or awards attorney’s fees, a lodestar fee (hours multiplied by a reasonable rate) carries a strong presumption that it is sufficient and reasonable. That presumption may be overcome only in a rare and exceptional circumstance, with evidence that competent counsel could not otherwise be retained. See Fla. Stat. § 57.104.

Fee clauses matter too.
