Wilson · Published October 19, 2026

Florida employer legal risks come from everyday decisions about workers. Hiring, pay, discipline, and firing can each lead to a lawsuit, an agency charge, or a penalty. This page explains the main laws and common mistakes. It is general information, not legal advice about your situation.

KEW Legal is a business law firm with offices in Coral Gables and Sunny Isles Beach. The firm acts as outside general counsel for business owners and investors across Miami-Dade and South Florida. Kristina E. Wilson is the attorney responsible for this page.

What Florida Employer Legal Risks Cover and Who Faces Them

Employer legal risk is the chance that a workforce decision leads to a claim, a charge, or a penalty. Owners, HR staff, and managers all make these decisions, so all of them carry the exposure. Employers in Miami-Dade, Broward, and nearby counties face the same core rules.

The main risk areas include:

Hiring, screening, and job advertisements

Pay, overtime, and how workers are classified

Harassment, discrimination, and retaliation

Handbook rules and how supervisors apply them

Federal and Florida law both reach these areas. Which law applies depends on the issue, the size of the employer, and the facts. A claim can cost time and money, and it can pull owners away from running the business.

If a worker's complaint or a pay question has you weighing your next step, our team can review the facts with you in a free, confidential first consultation. Federal law bars employers from discriminating based on race, color, religion, sex, and national origin under 42 U.S.C. § 2000e-2.

Florida’s version appears in Fla. Stat. § 760.10. It covers similar grounds and adds pregnancy, age, handicap, and marital status.

Disability discrimination is covered by 42 U.S.C. § 12112. The law bars discrimination in hiring, advancement, discharge, and pay. It also requires reasonable accommodation unless that accommodation would cause undue hardship on the business.

Pay rules come from several sources. The federal minimum wage appears in 29 U.S.C. § 206. Florida’s rate is set under the Florida Constitution, Article X, section 24. That text sets Florida’s minimum wage and provides for later adjustments to that rate.

Hiring and Screening Risks for Florida Employers

Hiring risk starts with the criteria you use and how you apply them. Title VII protects applicants as well as employees. A screening rule that treats applicants differently because of a protected trait creates exposure.

Job notices carry risk too. Federal law makes it unlawful to publish a notice showing a preference or limit based on race, color, religion, sex, or national origin.

Medical questions are limited. Federal disability law generally allows an employer to require a medical exam of an employee, or to ask whether an employee has a disability, only when the exam or question is job-related and consistent with business necessity.

Practical steps help. Write down your hiring criteria before interviews. Apply them the same way to every candidate. Keep records that show why each decision was made. Background checks raise separate rules that this page does not cover.

Discrimination, Harassment, and Retaliation Exposure

Harassment becomes an employer problem when managers ignore it or respond too slowly. Under 29 C.F.R. § 1604.11, unwelcome sexual conduct can be harassment. It qualifies when it unreasonably interferes with work or creates an intimidating, hostile, or offensive environment.

Whether conduct qualifies depends on the whole record and the totality of the circumstances. The context of the conduct matters as much as the words or acts themselves.

An employer can be responsible for co-worker harassment. That applies when the employer knew or should have known about it. The defense is showing immediate and appropriate corrective action. Waiting to see whether a complaint fades is a common and costly mistake.

Retaliation is a separate risk. It is unlawful to discriminate against an employee for opposing a practice made unlawful by Title VII, or for taking part in a charge or proceeding under 42 U.S.C. § 2000e-3. Florida also bars retaliation against a person exercising minimum wage rights under Fla. Stat. § 448.110.

Wage, Classification, and Policy Risks

A contract label does not decide whether wage laws apply. Under 29 C.F.R. § 795.105, calling workers “independent contractors” does not remove federal protections. The test looks at the economic realities of the relationship. It asks whether the worker depends on you for work or runs a business of their own.

The amount of income a worker earns is not the deciding factor. Other income sources don’t decide it either.

Florida sets its own steps for unpaid minimum wage claims. Under Fla. Stat. § 448.110, before suing for unpaid minimum wages, a worker must first give the employer written notice of the intent to sue, and the employer then has 15 calendar days after receiving it to pay or otherwise resolve the claim. The notice must state the wage claimed, the work dates and hours, and the total unpaid amount. If the worker wins, the worker recovers the full unpaid back wages plus the same amount as liquidated damages (extra damages), plus reasonable attorney’s fees and costs. A court may reduce the extra damages if the employer proves by a preponderance of the evidence that it acted in good faith and had reasonable grounds, and the court may award no extra damages or any amount not exceeding the unpaid minimum wages.

Handbooks work best when written before a problem arises. A useful handbook explains how to raise a concern and what happens after a complaint. Review policies when your duties or the law change. Train managers on how the rules apply in daily work.

How Outside General Counsel Handles Employment Matters: What to Expect

Outside general counsel work starts with a review of your workforce facts and documents. Advice then follows a written scope. The steps below describe the general model. They are not a promise about any particular matter.

Initial consultation. You describe your workforce, your documents, and your question. The first consultation is free, confidential, and without obligation to continue.

Written scope. The engagement describes the services covered and any fees or costs you may owe.

Document review. We review handbooks, offer letters, contractor agreements, and pay records. We list gaps in order of priority.

Drafting and advice. We draft or revise policies and agreements. We explain how to apply them to current situations.

Ongoing counsel. Questions that come up fall within the engagement’s scope. Employment issues often connect to leases, vendor contracts, partnership disputes, and succession planning.

Our support staff handles administration under the supervision of Kristina E.
